## Is general business liability enough for my work as a data protection officer?

No. Business liability pays for injury and property damage, for example if you knock over a screen at a client's office. Your real risk is pure financial loss: the client loses money because a recommendation, a notification or an audit was wrong. For that you need professional indemnity cover that names your work as an external data protection officer.

## At a glance

- **Compulsory:** No statutory insurance duty for external data protection officers. Your clients must appoint one if, as a rule, at least 20 people are constantly involved in automated processing of personal data (section 38 BDSG, the Federal Data Protection Act) or a case under Art. 37 GDPR applies
- **Biggest risk:** Wrong advice after which the client faces a fine, compensation claims or remedial work and holds you liable
- **Basic cover from:** about €250 a year for professional indemnity with €250,000 cover, a guide figure from our quoting work
- **Fines for the client:** Breaches of the duties in Art. 37 to 39 GDPR can be fined up to €10 million or 2 percent of worldwide annual turnover (Art. 83(4) GDPR)
- **Often forgotten:** External officers work under a service contract (Art. 37(6) GDPR). The liability clauses in it must match your sum insured

## What goes wrong in this trade

- **A breach assessed wrongly:** You decide an incident does not need to be reported; the supervisory authority disagrees. The client wants you to pay for the proceedings and the remedial work.
- **Incomplete documents:** Records of processing, processor agreements or impact assessments are incomplete. An audit finds out, and the client asks what they paid you for.
- **Data loss at your own office:** You hold documents for many clients. A hacked mailbox or a lost laptop affects several clients at once.
- **One template, many claims:** A faulty template for consent forms is used by twenty clients. One mistake becomes twenty claims.
- **Fee disputes:** A client terminates, refuses to pay and alleges poor work. That needs a lawyer, not liability insurance.
- **You are the business:** If you are ill for months, your clients still need advice, but your income stops.

**Risk radar** (Compared with other trades, 1 low to 5 high.): Liability 5, Fire and water 1, Theft 2, Cyber 5, Downtime 3, Health 2

## The insurance you need

- **Professional indemnity** (Essential): Professional indemnity pays justified claims from faulty advice and defends unjustified ones. Your work as an external data protection officer must be named in the policy. https://www.nammert.com/en/insurance-broker-professional-indemnity.php
- **Cyber insurance** (Strongly advised): For attacks on your own systems, where documents of many clients are stored, including help with recovery and notification. https://www.nammert.com/en/insurance-broker-cyber-insurance.php
- **Business liability** (Strongly advised): For injury and property damage during on site visits, training sessions and audits; often combined cheaply with professional indemnity. https://www.nammert.com/en/insurance-broker-business-liability.php
- **Business legal expenses** (Strongly advised): For fee disputes and arguments over contract clauses, which liability insurance does not handle. https://www.nammert.com/en/insurance-broker-business-legal-expenses.php
- **Occupational disability** (Strongly advised): Protects your income if illness stops you from advising clients. https://www.nammert.com/en/insurance-broker-occupational-disability.php
- **Electronic equipment** (Depends on the business): Replaces laptop, tablet and training equipment after theft, drops or water damage, also on the road. https://www.nammert.com/en/insurance-broker-electronic-equipment.php
- **D&O insurance** (Depends on the business): For managing directors of a data protection GmbH with several consultants, who can be personally liable. https://www.nammert.com/en/insurance-broker-directors-and-officers.php

## What it costs: example prices

Premiums depend on turnover, number of clients, the sectors your clients work in and the sum insured. Clients in healthcare or finance often ask for higher limits.

| Insurance | Example | Typical range |
| --- | --- | --- |
| Professional indemnity | Solo officer, €80,000 turnover, €250,000 cover | about €250 to €450 a year |
| Professional indemnity | Solo officer, €80,000 turnover, €1 million cover | about €600 to €1,200 a year |
| Professional indemnity | Practice with four consultants, €500,000 turnover, €2 million cover | about €2,000 to €4,500 a year |
| Cyber insurance | Small consulting office, €250,000 cover | about €300 to €700 a year |
| Business liability | Office liability as an add on, €3 million cover | about €80 to €200 a year extra |

For comparison: Professional indemnity for a solo data protection officer costs about as much a year as two monthly retainers from a small client.

## Our suggestions: three packages

- **Solo** (external data protection officer without staff): Professional indemnity, Business liability. Together: about €350 to €650 a year
- **Practice** (data protection consultancy with two to five consultants and many clients): Professional indemnity, Business liability, Cyber insurance, Business legal expenses. Together: about €2,500 to €6,000 a year
- **GmbH** (data protection company with managing directors, corporate clients and its own software): Professional indemnity, Business liability, Cyber insurance, Business legal expenses, D&O insurance, Electronic equipment. Together: individual, usually from about €6,000 a year

## The worst day as a data protection officer

Six things that really happen to external data protection officers, all on one Monday. Tap through and see who pays.

- 08:15: A client sends a newsletter with all recipients visible. You advise against reporting it, the authority opens proceedings later, and the client claims its costs from you. (€18,000, Paid by: Professional indemnity)
- 10:30: Your privacy notice template contains an outdated clause. Three clients have to have websites and forms revised. (€9,500, Paid by: Professional indemnity)
- 12:40: During a training session at a client's office, a participant trips over your projector cable and breaks her wrist. (€7,000, Paid by: Business liability)
- 14:05: Your mailbox is taken over through a fake login page. A specialist secures the systems and checks which client data is affected. (€12,000, Paid by: Cyber insurance)
- 16:20: Your laptop with audit documents is stolen on the train. (€2,200, Paid by: Electronic equipment)
- 18:00: A former client refuses to pay three invoices and alleges poor work. You need a lawyer. (€3,500, Paid by: Business legal expenses)

**Damage so far:** €52,200

## Practical tips from your broker

- Have your work as an external data protection officer and privacy consultant named explicitly in the professional indemnity policy, not just general management consulting.
- Compare the liability clauses in your service contracts with your sum insured. No policy covers unlimited contractual liability.
- Check the annual aggregate limit. If many clients use the same template, one mistake can trigger several claims in one year.
- Put your recommendations in writing, especially on data breaches. It helps to defend unjustified claims.
- Ask about run off cover for the time after a contract ends. Claims from old clients often arrive years later.
- Protect your own accounts with two factor login. Many cyber insurers ask about it before offering cover.

## Why NAMMERT for your business

- **Family business, placing cover since 1989:** Our work costs you nothing; the insurer pays our commission. You get named contacts instead of a hotline, in English or German.

## FAQ

### Does an external data protection officer have to be insured?

Not by law. Many clients do require proof of professional indemnity with a set sum insured in the contract.

### When does a business in Germany have to appoint a data protection officer?

As a rule when at least 20 people are constantly involved in automated processing of personal data (section 38 BDSG), and also in the cases of Art. 37 GDPR, for example large scale processing of health data as a core activity.

### What does professional indemnity for data protection officers cost?

For a solo officer with €250,000 cover about €250 to €450 a year, with €1 million about €600 to €1,200. These are guide values from our quoting work.

### What sum insured makes sense?

At least what your clients require in the contract. If you advise clients in healthcare, finance or with large customer databases, €1 million or more is usual.

### Do I also need cyber insurance?

Professional indemnity pays for mistakes in your advice. An attack on your own systems, with costs for recovery and your own notification, is a separate risk covered by cyber insurance.

### Does this page apply to internal data protection officers?

It is written for external officers with a service contract. Internal officers are employees, and their liability follows from the employment relationship.
