## Will insurance pay if I get a warning letter for hidden advertising?

If your professional indemnity includes unfair competition law, the insurer checks the warning letter, pushes back on excessive demands and pays justified claims. Not covered are contractual penalties from a cease and desist declaration you have already signed, and deliberate breaches. So do not sign anything before you have reported the case.

## At a glance

- **Compulsory:** No general legal requirement; for drone footage, owner's liability insurance is mandatory in Germany
- **Biggest risk:** Warning letters over image, music and trade mark rights and missing ad labels
- **Basic cover from:** about €135 a year for professional indemnity for creators
- **Statutory accident insurer:** solo self employed creators are not automatically covered by a Berufsgenossenschaft (statutory accident insurer) and usually join the VBG voluntarily; with employees membership is compulsory
- **Often forgotten:** The account itself: only cyber insurance pays for recovery and crisis communication after a hack
- **WZ 2025 / NACE:** 60.39 Sonstige Verbreitung von Medieninhalten

## What goes wrong in this trade

- **Music and images:** A song in the background, a photo from a search engine, a clip from a series: rights holders and agencies find infringements automatically.
- **Ad labelling:** If you show, link to or were given a product, German law says you must label it as advertising. Associations and competitors send warning letters over missing labels all the time.
- **Mistakes in brand deals:** A wrong discount code, an old price, a remark that harms the brand: the partner wants compensation.
- **Hacked account:** Hijacked profiles are used for scams, and reach and income collapse. Getting the account back costs time and money.
- **Shoots and events:** Filming in a café, at events or while travelling can cause injury and property damage that you are liable for.
- **Kit on the move:** Camera, laptop, gimbal and drone travel with you constantly and get stolen, dropped or soaked.

**Risk radar** (Compared with other trades, 1 low to 5 high.): Liability 4, Fire and water 2, Theft 3, Cyber 5, Downtime 3, Health 2

## The insurance you need

- **Professional indemnity** (Essential): Covers financial loss and warning letters under copyright, trade mark, personality and unfair competition law, which are the typical creator claims. https://www.nammert.com/en/insurance-broker-professional-indemnity.php
- **Cyber insurance** (Strongly advised): Pays for IT forensics, account recovery and crisis communication after a hack. https://www.nammert.com/en/insurance-broker-cyber-insurance.php
- **Business liability** (Strongly advised): Covers injury and property damage at shoots, events and on location for brand partners. https://www.nammert.com/en/insurance-broker-business-liability.php
- **Electronic equipment** (Strongly advised): Replaces camera, smartphone, laptop and lighting after breakage, theft and water damage, including while travelling. https://www.nammert.com/en/insurance-broker-electronic-equipment.php
- **Drone insurance** (Depends on the business): If you film with a drone you need commercial drone liability insurance; German law requires it. https://www.nammert.com/en/insurance-broker-drone-insurance.php
- **Business legal expenses** (Depends on the business): Legal expenses for disputes with agencies and brand partners over fees and contracts. https://www.nammert.com/en/insurance-broker-business-legal-expenses.php
- **Occupational disability** (Depends on the business): Without your face, voice and health there is no content, and the self employed have no state cover for this in Germany. https://www.nammert.com/en/insurance-broker-occupational-disability.php

## What it costs: example prices

Creator policies are cheap while turnover is modest. They cost more with high brand deal income, your own team and topics such as money, health or product testing.

| Insurance | Example | Typical range |
| --- | --- | --- |
| Professional indemnity | Creator starting out, financial loss and rights infringements | about €135 to €300 a year |
| Professional indemnity | Creator with €100,000 brand deal turnover, including public liability | about €350 to €800 a year |
| Electronic equipment | Camera, laptop and lighting worth €5,000, worldwide | about €150 a year including tax |
| Cyber insurance | Solo creator with social media accounts and a web shop | about €200 to €500 a year |

For comparison: Professional indemnity for creators costs about as much a year as a single small product deal brings in.

## Practical tips from your broker

- Make sure unfair competition law, and with it warning letters over ad labelling, is expressly included.
- Do not sign a cease and desist declaration before the insurer knows about the case; later contractual penalties are not covered.
- Ask whether the cyber policy covers social media accounts and lost income after a hack.
- Insure your kit worldwide, including in checked flight baggage and in hire cars.
- If a brand contract asks you to accept more liability than the law requires, show that clause to the insurer first.
- For topics such as money, law and health you need a higher limit for your followers' financial losses.
