# Insurance for municipalities, towns and districts in Germany

> A German municipality is liable for roads, playgrounds, trees and swimming pools, owns the town hall, schools and depot, and employs staff who issue official decisions. Many municipalities, towns and districts cover this through municipal loss pools (kommunale Schadenausgleiche) or framework contracts. This page explains honestly how that works, which risks remain and where an insurance broker can genuinely help.

## We are already in a municipal loss pool. Why would we need a broker?

For what the pool does not cover, or covers only in part, and to check whether cover and contribution still fit. A broker can review your portfolio, point out gaps in areas such as cyber, electronics or own losses, and prepare a tender professionally. Whether a change makes sense depends on the case; often the existing solution is a good one.

## At a glance

- **How they are insured:** Often through municipal loss pools, for example the KSA in Brandenburg, Mecklenburg-Vorpommern, Saxony, Saxony-Anhalt and Thuringia, or through tendered framework contracts
- **Biggest risk:** Liability for road and site safety and for breaches of official duty, plus damage to buildings and cyber attacks on the administration
- **Official liability:** Under section 839 of the German Civil Code (BGB), an official who breaches a duty owed to a third party, intentionally or negligently, must compensate the damage
- **Accident insurance:** Volunteers working for public law bodies are covered by statutory accident insurance under section 2 SGB VII; the public sector accident funds (Unfallkassen) are responsible
- **Often forgotten:** Losses to the municipality itself caused by its own staff, such as missed grant deadlines or wrongly calculated fees

## What goes wrong in this trade

- **Road and site safety:** A branch falls on a parked car, a cyclist hits a pothole, a child is hurt on a playground.
- **Breach of official duty:** A building permit is granted unlawfully or delayed, and an investor claims damages.
- **Buildings and facilities:** Fire in the sports hall, heavy rain in the town hall cellar, a burst pipe in the nursery.
- **Cyber attack:** Encrypted servers shut down the citizens' office and payments for weeks, and residents' data is affected.
- **Vehicles:** Gritters, refuse trucks and pool cars are on the road every day, often in difficult conditions.
- **Own losses:** A grant deadline is missed. The loss hits the municipality's own budget, not a third party.

**Risk radar** (Compared with other trades, 1 low to 5 high.): Liability 5, Fire and water 4, Theft 3, Cyber 5, Downtime 3, Health 4

## What it costs: example prices

Municipal premiums depend on population, facilities, building values, vehicles and claims history. The ranges below are rough guide values and do not replace a tender.

| Insurance | Example | Typical range |
| --- | --- | --- |
| Business liability | Municipality of about 3,000 residents with roads, playgrounds and a nursery | about €3,000 to €8,000 a year |
| Commercial buildings | Town hall, primary school and sports hall worth €15 million in total | about €10,000 to €25,000 a year |
| Cyber insurance | Administration with 40 workstations, €1 million sum insured | about €4,000 to €12,000 a year |
| Fleet insurance | Depot with eight vehicles, liability and partial cover | about €5,000 to €12,000 a year |

For comparison: Liability cover for a small municipality costs about as much a year as refurbishing two pieces of playground equipment.

_Guide values from our quoting practice, excluding insurance tax, as of October 2026. Many municipalities are covered by loss pools that calculate contributions differently._

## The worst day at the town hall

Six losses municipalities really face, here all on one stormy Monday. Tap through and see which line of cover applies.

- 06:30: A storm brings down a lime tree from the park onto two parked cars. (€18,000, Paid by: Business liability)
- 08:15: The citizens' office stops working: ransomware has encrypted the servers. (€120,000, Paid by: Cyber insurance)
- 10:40: The depot's gritter slides into a garden wall. (€9,000, Paid by: Fleet insurance)
- 13:20: Water comes through the damaged sports hall roof and the floor swells. (€60,000, Paid by: Commercial buildings)
- 15:00: A grant deadline has passed. The municipality loses a six figure subsidy. (€150,000, Paid by: D&O insurance)
- 17:30: A child falls from playground equipment with a loose railing. (€12,000, Paid by: Business liability)

**Damage so far:** €369,000

## Practical tips from your broker

- Check regularly what your loss pool or framework contract excludes, especially cyber and electronics.
- Keep complete records of tree inspections and playground checks. In a liability case, proof counts.
- Keep building values up to date, especially after refurbishments and extensions.
- Clarify whether own losses caused by staff errors are covered; liability insurance only pays third party damage.
- Plan insurance tenders early; they need lead time and a clear risk description.

## FAQ

### How are German municipalities usually insured?

Many through municipal loss pools covering liability, motor and accident, others through tendered contracts with insurers. Buildings and cyber are often arranged separately.

### Who is liable when a member of staff makes a mistake?

If an official intentionally or negligently breaches a duty owed to a third party, section 839 BGB creates a duty to compensate. Municipal liability cover examines such claims and settles justified ones.

### Are volunteers helping the municipality insured against accidents?

People volunteering for a public law body are covered by statutory accident insurance under section 2 SGB VII. The public sector Unfallkassen are responsible.

### Does liability insurance cover losses to the municipality's own budget?

No. Liability insurance pays third party damage. Own losses caused by staff errors need separate financial loss cover.

### What can a broker do for a municipality?

Portfolio review, gap analysis, tender preparation and comparison of offers. Whether to change is decided by the municipality under procurement law.
