# Insurance for market research agencies, pollsters and test studios in Germany

> A weighting error that skews a study, a panel whose addresses end up online, a tasting in the test studio after which a participant has an allergic reaction: market research is about data, numbers and people. There is no compulsory insurance for the profession in Germany, but the GDPR makes mistakes expensive. This page explains what agencies, pollsters and test studios should insure.

## Is an agency liable if a client loses money because of a wrong study?

Yes, if an error is proven, for example in sampling, weighting, analysis or reporting. That is a pure financial loss, such as a product launch based on wrong figures. Ordinary public liability does not cover it. You need professional indemnity that describes your research services explicitly.

## At a glance

- **Compulsory:** No compulsory insurance for the profession; clients often require professional indemnity in framework contracts
- **Data protection:** Anyone who suffers material or non-material damage from a GDPR breach has a right to compensation (Art. 82 GDPR)
- **Fines:** Up to 20 million euros or 4 percent of worldwide annual turnover (Art. 83 (5) GDPR); breaches must be reported within 72 hours (Art. 33)
- **Biggest risk:** Faulty studies that lead to wrong decisions by the client, and breaches involving respondent data
- **Basic cover from:** around 500 euros a year for professional indemnity in a small agency, a guide value from our quoting experience

## What goes wrong in this trade

- **Errors in studies:** Wrong weighting, swapped codes or a calculation error in the report lead to wrong decisions by the client.
- **Panel data breach:** Addresses, answers or health details of respondents reach unauthorised people; data subjects and authorities get in touch.
- **Server attack:** The survey platform is encrypted during fieldwork; deadlines slip and data must be restored.
- **Test studio:** During tastings and product tests participants react, fall or damage prototypes.
- **Confidentiality:** Unreleased products and concepts of the client become known too early.
- **Field interviewers:** Freelance interviewers cause damage or ignore data protection rules.

## What it costs: example prices

The premium depends on turnover, methods, the data processed and the sum insured. Health and financial data and test studios increase it.

| Insurance | Example | Typical range |
| --- | --- | --- |
| Professional indemnity | Small agency, turnover 400,000 euros, 500,000 euros cover | around 500 to 1,200 euros a year |
| Professional indemnity | Agency with 30 staff, turnover 3 million euros, 2 million euros cover | around 3,000 to 7,000 euros a year |
| Cyber insurance | Agency with online panel and 20 workstations, 1 million euros | around 2,000 to 5,000 euros a year |
| Business liability | Test studio with tastings, 5 million euros combined | around 400 to 1,000 euros a year |
| D&O insurance | GmbH with two managing directors, 1 million euros | around 1,000 to 2,500 euros a year |

For comparison: Professional indemnity for a small agency costs about as much a year as two focus groups.
