# Insurance for social services, youth welfare and advice centres in Germany

> In youth welfare and social work you look after people who often cannot or will not answer for damage themselves. A teenager from your residential group damages a car, a client floods their flat, someone is hurt on the drive to an appointment. On top of that you hold highly protected personal data, and your board works with public money.

## Who pays if a young person from our residential group damages something?

First the young person, if they have their own liability insurance, which is rare. A claim against your organisation only exists if supervision was inadequate. So that the injured party is not left empty-handed, and neighbours and landlords stay on your side, good policies offer an extension for damage caused by clients even when your organisation was not at fault.

## At a glance

- **Compulsory:** No general statutory insurance duty; but the service agreements with the youth welfare office (Jugendamt) and other funding bodies almost always require liability cover, and vehicles used for transport need compulsory motor liability
- **Biggest risk:** Damage caused by the people in your care and allegations that you failed in your duty of supervision
- **Basic cover from:** about 300 to 800 euros a year for the public liability cover of a small organisation with one residential group or advice centre
- **Statutory accident insurer:** BGW (the Berufsgenossenschaft for health and welfare services) for employees; volunteers in the welfare sector are also covered there by law
- **Often forgotten:** Damage caused by clients who cannot be held legally responsible: without a special extension, liability insurance only pays if your organisation itself was at fault
- **WZ 2025 / NACE:** 88.99 Sonstiges Sozialwesen a. n. g.

## What goes wrong in this trade

- **Damage caused by clients:** A scratched car, a smashed shop window, a fire from a hob left on: the people you support cause damage that nobody else will pay for.
- **Supervision and responsibility:** A teenager runs away from the residential group and injures someone, a child has an accident on a holiday trip. Then the question is whether supervision was adequate.
- **Transport and outings:** Minibuses full of clients, staff using their own cars for work trips: accidents with clients on board are expensive and distressing.
- **Rented flats:** Supported living usually takes place in rented flats. Escape of water, vandalism and lost keys all hit the landlord's property.
- **Protected social data:** Care plans, health information, reports to the youth welfare office: this data enjoys special legal protection, and a data breach can put your relationship with funding bodies at risk.
- **Staff under strain:** Assaults by clients, night shifts, stress: accidents at work and psychological strain are common in social work.

**Risk radar** (Compared with other trades, 1 low to 5 high.): Liability 4, Fire and water 3, Theft 2, Cyber 3, Downtime 2, Health 4

## What it costs: example prices

Premiums depend on the type of care, the number of places and staff, and the organisation's budget. Residential groups are rated higher than open youth clubs or advice centres.

| Insurance | Example | Typical range |
| --- | --- | --- |
| Business liability | Advice centre or youth club run by a registered association with up to 50,000 euros turnover | about 180 to 450 euros a year |
| Business liability | Organisation with one residential group of eight places, including damage caused by clients | about 500 to 1,200 euros a year |
| D&O insurance | Board of an association with a budget of 2 million euros | about 500 to 1,100 euros a year |
| Cyber insurance | Organisation with around 1 million euros turnover and digital case records | about 500 to 900 euros a year |
| Fleet insurance | Two minibuses for transport services, fully comprehensive | about 1,800 to 3,500 euros a year |

For comparison: Liability cover for a residential group costs about as much a year as two to four daily rates for one supported place.

- 19:00: The federal state reclaims grants because the board billed staff costs incorrectly. (€45,000, Paid by: D&O insurance)

## Practical tips from your broker

- Make sure damage caused by clients is expressly included even when your organisation is not at fault, with a limit that suits the people you support.
- Include damage to all rented flats and premises and the loss of keys in your liability policy.
- Check your service agreements with the youth welfare office and other funding bodies for the minimum sums insured they require.
- Cover staff members' own cars on work trips with business travel insurance for their vehicles.
- Protect social data with two-factor login and off-site backups; many cyber insurers make this a condition.
- Always report assaults by clients to the BGW, even without visible injury: psychological effects can appear later.

## Why NAMMERT for your business

- **We understand non-profit providers:** Budgets are tight and funding bodies set strict rules. As a broker we get quotes from several insurers and cover what your agreements really require.
- **We know claims from the inside:** In boat insurance we handle claims ourselves. That experience helps when it has to be settled who pays after damage caused by a client.
- **Board and organisation together:** We align liability, D&O, vehicles and data cover so that after an incident no policy points to another.
- **A family business since 1989:** Boards change, contacts should not. With us you keep the same people, and our work costs your organisation nothing because the insurer pays our commission.

## FAQ

### Does a youth welfare provider in Germany have to be insured?

There is no general legal duty, but in practice the operating licence and service agreements assume liability cover. Vehicles need compulsory motor liability insurance.

### Is our organisation liable for damage caused by the young people we look after?

Only if supervision was inadequate. Otherwise many injured parties are left with the cost. An extension for damage caused by clients pays up to a set limit even when you were not at fault.

### Are our volunteers covered for accidents?

In the welfare sector, yes, through the BGW, the statutory accident insurer. For their liability, your public liability policy should name volunteers as insured persons.

### Does an advice centre need professional indemnity cover?

Yes, if it gives advice on legal or financial matters such as debt, welfare benefits or tenancy law. Wrong information can cost clients money.

### What does insurance for a residential group cost?

Liability cover including damage caused by clients is usually about 500 to 1,200 euros a year. With D&O, contents and cyber it comes to about 1,500 to 3,200 euros.

### Who pays if a staff member drives a client in their own car?

Damage to others is paid by the staff member's own motor liability insurance. Damage to their own car is only covered if your organisation has business travel cover for staff vehicles; otherwise the staff member bears it.
