# Insurance for hiking guides and mountain guides working in Germany

> Guiding people on trails, via ferratas or glaciers means you are responsible for their safety. If a guest slips on a wet path or you misjudge the weather, the talk quickly turns to medical bills, rescue costs and lost earnings. This page is for English speaking guides based in Germany and explains which insurance covers this, what it costs and which German rules apply.

## Don't guests on a mountain take their own risk?

Only partly. When you guide for money, you take on a contractual duty to judge the route, the weather and the group's ability properly. If a guest is hurt and a mistake in planning, equipment checks or belaying can be shown, you are liable for medical costs, compensation for pain and suffering and lost earnings. A liability policy that clearly covers guided tours checks such claims, fights unjustified ones and pays justified ones.

## At a glance

- **Compulsory:** No general statutory insurance duty for hiking or mountain guides in Germany. If you sell multi day tours combining accommodation or transport with guiding, you are a package travel organiser and must protect customer payments under § 651r BGB (German Civil Code)
- **Biggest risk:** A guest is injured and the claim says the route, the weather call or the rope work was wrong
- **Basic cover from:** about €150 a year of liability for a hiking guide on marked trails, a guide figure from our quoting work
- **Qualification:** State certified mountain and ski guides (staatlich geprüfte Berg- und Skiführer) train under the Bavarian training and examination rules; the title is protected
- **Often forgotten:** Your own accident: if you are injured, the season's income goes with it

## What goes wrong in this trade

- **A guest falls:** A participant slips on wet rock and breaks an ankle. Helicopter rescue, surgery and weeks off work: the claims land with the guide.
- **The wrong route:** Thunderstorm, fresh snow or a stage that is too long: in a dispute the question is whether the tour suited the group and the forecast.
- **Rental gear:** You provide crampons, harness or helmet. If an item fails or was badly adjusted, the blame falls on whoever handed it out.
- **Your own injury:** A twisted knee on the descent and the summer is over. Booked tours have to be cancelled.
- **Package tours:** Selling hut nights, transfers and guiding together makes you a package organiser, with duties on cancellations and insolvency protection.
- **The drive to the trailhead:** Many guides pick guests up in their own minibus. A crash on the way involves motor insurance and guests at the same time.

**Risk radar** (Compared with other trades, 1 low to 5 high.): Liability 5, Fire and water 2, Theft 2, Cyber 1, Downtime 4, Health 5

## The insurance you need

- **Business liability** (Essential): Covers injury and property damage suffered by guests or third parties on guided tours. Make sure your activities, such as via ferrata, high alpine tours or ski touring, are named in the policy. https://www.nammert.com/en/insurance-broker-business-liability.php
- **Accident insurance** (Strongly advised): Pays a lump sum for permanent injury and can include rescue costs, which quickly run into thousands of euros in the mountains. https://www.nammert.com/en/insurance-broker-accident-insurance.php
- **Occupational disability** (Strongly advised): Your knees, back and fitness are your capital. If you can no longer guide, you need an income. https://www.nammert.com/en/insurance-broker-occupational-disability.php
- **Business legal expenses** (Strongly advised): Helps if prosecutors investigate after an accident, if a guest sues, or in disputes over cancellations and invoices. https://www.nammert.com/en/insurance-broker-business-legal-expenses.php
- **Car insurance** (Depends on the business): If you carry guests in your own vehicle for payment, you must declare this use to your motor insurer. https://www.nammert.com/en/insurance-broker-car-insurance.php
- **Travel insurance** (Depends on the business): For tours in other Alpine countries and further afield: medical cover and repatriation for yourself. https://www.nammert.com/en/insurance-broker-travel-insurance.php
- **Electronic equipment** (Depends on the business): For GPS units, radios, laptop and camera used to plan and document tours. https://www.nammert.com/en/insurance-broker-electronic-equipment.php

## What it costs: example prices

Premiums depend mainly on what you guide. A walk on marked trails costs much less to insure than high alpine tours, via ferratas or ski touring. Group size, turnover and the countries you work in also count.

| Insurance | Example | Typical range |
| --- | --- | --- |
| Business liability | Hiking guide on marked trails, Germany and Alpine countries, €5 million limit | about €150 to €350 a year |
| Business liability | State certified mountain and ski guide with high alpine tours, climbing and ski touring | about €500 to €1,400 a year |
| Accident insurance | Guide aged 40, €150,000 base sum including rescue costs | about €200 to €450 a year |
| Business legal expenses | Self employed guide with criminal and contract legal expenses | about €300 to €650 a year |
| Car insurance | Nine seat minibus, commercial use, liability and partial cover | about €900 to €2,000 a year |

For comparison: A hiking guide's liability cover costs about as much per year as one or two guided day tours.

## The worst day in the mountains

Six things that really happen to hiking and mountain guides, here all on one August day. Tap through and see who pays.

- 09:45: A guest kicks loose a stone that hits a hiker further down on the shoulder. (€4,500, Paid by: Business liability)
- 11:20: A participant slips on wet rock and breaks her ankle. Helicopter rescue, surgery, two months off work. (€24,000, Paid by: Business liability)

- 17:30: Your GPS unit and radio fall into a gully and are lost. (€900, Paid by: Electronic equipment)
- 20:10: The injured participant's lawyer announces a lawsuit, claiming you chose the wrong route. (€4,000, Paid by: Business legal expenses)

**Damage so far:** €56,900

## Practical tips from your broker

- Have every activity named in your liability policy: hiking, via ferrata, high alpine tours, ski touring, snowshoeing. Anything missing may not be covered.
- Check that the policy applies in every country where you guide and that rental equipment is included.
- Record route planning, the weather forecast and equipment checks. In a dispute this is your best evidence.
- If you sell huts, transfers and guiding as a package, you are a travel organiser. Sort out customer money protection under § 651r BGB before taking deposits.
- Include rescue costs in your accident cover, and tell your guests to arrange their own.
- Tell your motor insurer if you drive guests for payment; a private use policy no longer fits.

## FAQ

### Is liability insurance compulsory for hiking guides in Germany?

There is no general statutory duty. Without it, however, you pay claims after an accident yourself, and many clients such as hotels, mountain schools or municipalities ask for proof of cover.

### Am I a tour operator if I offer hut to hut tours?

If you sell at least two types of travel services together, such as accommodation and guiding, it is usually a package under § 651a BGB, and you must protect customer payments under § 651r BGB. Day trips under 24 hours without an overnight stay and costing no more than €500 are exempt.

### What does liability cover for a mountain guide cost?

About €150 to €350 a year for hiking guides on marked trails, and about €500 to €1,400 for mountain and ski guides with high alpine tours and ski touring, as guide figures.

### Does my cover apply in Austria, Switzerland and Italy?

Only if the policy includes those countries. Guides working in the Alps should have at least Europe covered.

### Are rescue costs covered?

For you, through accident insurance that includes rescue costs. For guests, your liability policy pays only if you are liable for the accident, so recommend that guests arrange their own cover.

### What is a state certified mountain and ski guide?

Training takes around three years and ends with state examinations under the Bavarian training and examination rules. The professional title is protected.
