# Legal expenses insurance in Germany: how it works and when it pays

## Do I need legal expenses insurance in Germany?

It is optional, but useful if you would otherwise hesitate to fight a dispute because of the cost. The strongest case is employment: in the first instance at a German labour court, each side pays its own lawyer even if it wins. Tenants also benefit, because disputes over service charges and rent increases are common. Buy it before trouble starts, since most modules have a three-month waiting period.

## Who pays legal costs in Germany

In German civil cases the losing side pays the court fees and both sides' statutory lawyer fees (Section 91 Code of Civil Procedure). Lawyer fees follow a fixed schedule (RVG) based on the value in dispute, so costs are more predictable than in the US, but a lost case means paying twice.

Employment cases are different. At the labour court (Arbeitsgericht), in the first instance each party pays its own lawyer, win or lose (Section 12a Labour Courts Act). If you are dismissed and challenge it, your lawyer's bill is yours in any case unless you are insured or a union member.

## The three-week deadline and the three-month wait

If your employer dismisses you and you want to challenge it, you must file a claim with the labour court within three weeks of receiving the written notice (Section 4 Dismissal Protection Act). Miss that deadline and the dismissal is usually treated as valid. Legal expenses insurance lets you act quickly without worrying about the bill.

The catch for newcomers: work, private and housing modules normally start only after a three-month waiting period, and the event that caused the dispute must happen after that. If you take out a policy when a conflict with your employer is already brewing, it will not be covered. The best time to buy is when you start a new job or sign a lease, not when trouble begins.

## What is never covered

Divorce and custody proceedings are excluded; most policies pay only an initial consultation. Disputes about building or financing a home, investments and speculation, and anything whose cause lies before the policy started are also excluded. Crimes that can only be committed intentionally are not covered, and if you are convicted of one, the insurer can reclaim what it paid.

If the insurer refuses cover because it sees no prospect of success, it must offer you a procedure in which an independent party decides (Section 128 Insurance Contract Act). That is worth using before you give up on a justified claim.

## What it costs

Legal expenses insurance is not cheap, because disputes are frequent. You control the premium through the modules you choose and your deductible. A deductible of 150 to 300 euros lowers the premium noticeably.

## The policy levels on the market

- **Traffic only:** Covers disputes around your car and traffic offences. Cheap and without waiting period, but no cover for work or housing.
- **Private, work and traffic:** The classic package for employees. Covers the most common disputes outside your home.
- **Private, work, traffic and housing:** Adds disputes with your landlord or neighbours about the home you live in. The complete package for tenants.

## Typical claims and who pays

- **Employer refuses a fair reference** (a few hundred to around 2,000 €): In Germany you have a legal right to a written reference (Arbeitszeugnis). Traffic only cover does not help, the work package does after the waiting period.
- **Landlord keeps your deposit** (around 1,000 to 3,000 €): Deposit disputes are among the most common expat cases. You need the housing module; without it no package pays.
- **Other driver blames you for a crash** (lawyer and expert around 2,000 to 6,000 €): Every traffic policy covers this. Having your own lawyer matters because the other side's insurer works for them, not you.
- **Speeding fine with a driving ban** (around 500 to 1,500 € for lawyer and report): Challenging the measurement is routine in Germany. It is part of every traffic cover.
- **Divorce with a dispute over the flat** (five figures if assets are contested): Family law is excluded almost everywhere. Some policies pay for a first consultation, not the proceedings.
- **Lost money in a crypto investment** (five figures and more): Disputes about investments are excluded in consumer policies. You carry the legal costs yourself.

## Myth or truth

- „In a German labour court you pay your own lawyer at first instance, even if you win." ✔ True: section 12a of the Labour Courts Act rules out reimbursement at first instance. The employer does not pay your lawyer. This surprises many people from the UK and US.
- „Legal expenses insurance covers a dispute that started before I took it out." ✘ False: German policies only cover disputes whose cause arises after cover begins, often after a waiting period of about three months. A problem that already existed stays excluded, even if you have not gone to court yet.
- „If I lose, my legal expenses insurance will also pay the fine." ✘ False: fines and penalties are never covered. The policy pays lawyers, court fees and experts, not the sanction.
- „Many German policies include a lawyer's advice by phone." ✔ True: phone advice from a lawyer is a common feature, often without a waiting period. It is a quick way to check whether a problem is worth pursuing. The exact rules differ by policy.

For most modules after a three-month waiting period. Traffic, damages and criminal defence modules usually apply from day one. What counts is when the cause of the dispute arose, not when you report it.

### Does it pay if I am dismissed?

Yes, if you have the work module and the dismissal came after the waiting period. File your claim at the labour court within three weeks of receiving the notice.

### Can I choose an English-speaking lawyer?

Yes. German law guarantees free choice of lawyer. Many insurers can also recommend lawyers who work in English, which is often useful in employment cases.

### Does it cover divorce?

No. Most policies pay only an initial consultation in family law. The divorce proceedings themselves are excluded.
