In short
Legal expenses insurance (Rechtsschutzversicherung) usually has a waiting period (Wartezeit) of three months, for example for employment, tenancy and contract disputes. For traffic law and damages claims there is usually none. If you switch from another legal expenses policy without a gap, the time already insured is often credited.
Guide figures from published tests and tariff examples, so you can weigh the waiting period against the premium.
| Example | Typical range |
|---|---|
| Single, four modules, EUR 300 deductible | about EUR 25 to 32 a month |
| Family, four modules | about EUR 32 to 40 a month |
| Family package private, work, traffic, EUR 150 deductible | about EUR 251 to 978 a year |
Guide values as of September 2026. For the waiting period, the terms of your tariff apply.
Worked example
When the tenancy law module applies.
| Policy start | 1 March |
| End of waiting period | 31 May |
| Rent increase demanded on 15 April | not covered |
| Defect and dispute from 10 June | covered |
Only disputes that begin after 31 May are covered under tenancy law.
The waiting period is meant to stop people from signing up only once trouble is on the horizon. That is why it applies mainly in areas where disputes tend to build up slowly.
The exact periods are in your policy terms and differ between tariffs.
| Area | Usual waiting period |
|---|---|
| Traffic law | none |
| Damages claims | none |
| Criminal law | usually none |
| Employment law | three months |
| Tenancy law | three months |
| Contract law | three months |
What matters is the legal breach, the moment the dispute arises. If your employer gives notice during the waiting period, the case is not covered, even if the lawsuit comes later.
If the trigger happened before the policy started, no insurer pays, however long you wait afterwards.
Legal expenses insurance is much more common in Germany than in the UK or US, partly because lawyers' fees follow a fixed statutory scale and courts often make the losing side pay. For people who move here for a job, the typical cases are an employment contract, a probation period that ends badly or a dispute over the deposit (Kaution) with a landlord.
Each of these falls under a three month waiting period. If you take out cover in your first weeks in Germany, you are protected by the time such problems usually start. A policy from your home country will rarely cover disputes under German law.
If you switch without a gap from another legal expenses policy with the same scope, many insurers credit the time you were insured there.
Some tariffs waive the waiting period for an extra charge. That only helps with disputes that arise after the policy starts.
Questions and answers
For traffic and damages claims usually yes. For employment and tenancy only with previous cover or as a special feature.
The waiting period runs from the agreed policy start date.
Then it stays uninsured for good, even after the waiting period ends.
Usually not for modules you already had, but yes for new ones.
Some tariffs pay for phone advice straight away, but that does not replace cover for court proceedings.
You can usually choose your lawyer freely. Fees are paid under the German statutory scale, so extra costs such as translation may not be covered.
