Legal expenses insurance pays for lawyers, court fees and experts when you need to enforce your rights or defend yourself. In Germany it is widespread and sold in modules: private life, work, traffic and housing. For newcomers the work module is often the reason to buy it, because German labour courts follow their own cost rules.
The question almost everyone asks first
It is optional, but useful if you would otherwise hesitate to fight a dispute because of the cost. The strongest case is employment: in the first instance at a German labour court, each side pays its own lawyer even if it wins. Tenants also benefit, because disputes over service charges and rent increases are common. Buy it before trouble starts, since most modules have a three-month waiting period.
In German civil cases the losing side pays the court fees and both sides' statutory lawyer fees (Section 91 Code of Civil Procedure). Lawyer fees follow a fixed schedule (RVG) based on the value in dispute, so costs are more predictable than in the US, but a lost case means paying twice.
Employment cases are different. At the labour court (Arbeitsgericht), in the first instance each party pays its own lawyer, win or lose (Section 12a Labour Courts Act). If you are dismissed and challenge it, your lawyer's bill is yours in any case unless you are insured or a union member.
If your employer dismisses you and you want to challenge it, you must file a claim with the labour court within three weeks of receiving the written notice (Section 4 Dismissal Protection Act). Miss that deadline and the dismissal is usually treated as valid. Legal expenses insurance lets you act quickly without worrying about the bill.
The catch for newcomers: work, private and housing modules normally start only after a three-month waiting period, and the event that caused the dispute must happen after that. If you take out a policy when a conflict with your employer is already brewing, it will not be covered. The best time to buy is when you start a new job or sign a lease, not when trouble begins.
Divorce and custody proceedings are excluded; most policies pay only an initial consultation. Disputes about building or financing a home, investments and speculation, and anything whose cause lies before the policy started are also excluded. Crimes that can only be committed intentionally are not covered, and if you are convicted of one, the insurer can reclaim what it paid.
If the insurer refuses cover because it sees no prospect of success, it must offer you a procedure in which an independent party decides (Section 128 Insurance Contract Act). That is worth using before you give up on a justified claim.
