Does legal insurance pay for a dispute with your neighbour in Germany?

In short

Yes, if you have property legal cover (Wohnungs- und Grundstücks-Rechtsschutz) for your house or flat. It pays in a dispute with your neighbour over the boundary, trees, noise or smells coming from the plot. Usually not covered are building disputes and cases that began before the policy or in the first three months. A lawyer's letter in a EUR 5,000 dispute alone costs about EUR 572.

Worked example

New dispute over overhanging branches

You have had property legal cover for your house for two years. The new neighbour plants a row of trees right on the boundary, branches grow over and he refuses to cut them.

First consultation with a lawyerup to EUR 226.10
Conciliation at the arbitration officea few dozen to a few hundred euros
Lawsuit at EUR 5,000, lostabout EUR 2,668
Your deductiblefor example EUR 150

The insurer bears advice, conciliation and lawsuit apart from the deductible. Without insurance the dispute can cost about EUR 3,000, more with expert reports.

Which module pays in a neighbour dispute

Neighbour disputes are almost always about the land: where the boundary runs, whether branches grow across, whether noise, smoke or smells must be tolerated. Legally this concerns your property rights. In German legal insurance that falls under property legal cover. The model conditions name a dispute over the course of the boundary as an example.

Only the property named in the policy is covered, and only in the capacity stated there, for example as owner. Private legal cover without this module usually does not help in a dispute about the land. Damages cover (Schadenersatz-Rechtsschutz) does not apply either, because claims based on infringing rights in land are excluded from it.

Long running disputes: the start decides

Neighbour disputes often drag on for years. For the insurer, what counts is the moment the neighbour first allegedly broke a legal duty. If the breach extends over a period, the model conditions say its start is decisive.

If the neighbour's hedge has grown over the boundary for years and you take out legal insurance now, that dispute is not covered. The same applies to breaches during the waiting period of usually three months. Insurance only helps with disputes that arise later.

Before going to court: mandatory conciliation

For many neighbour disputes, section 15a of the Introductory Act to the Code of Civil Procedure (EGZPO) allows the German states to require an attempt at settlement at a conciliation office (Gütestelle) before a lawsuit. This covers claims about emissions under section 906 of the Civil Code (BGB), overhanging branches under section 910 BGB and boundary trees under section 923 BGB. Without a certificate that conciliation failed, the lawsuit is inadmissible there.

Under the model conditions legal insurance pays the fees of conciliation, up to what the first instance at court would have cost. Whether conciliation is mandatory in your state is set by state law.

What a neighbour dispute costs

Without legal insurance you pay the lawyer according to the amount in dispute. A lawyer's letter in a EUR 5,000 dispute costs about EUR 572. If it goes to court and you lose, you pay both lawyers and the court under section 91 ZPO, at EUR 5,000 about EUR 2,670 in total. Expert reports on noise, trees or boundaries come on top.

With legal insurance the insurer bears these costs, minus your deductible. It does not pay any damage you owe the neighbour; that is for your personal liability insurance.

Tenants, and when you do not need cover

As a tenant, take noise from the flat next door to your landlord first. A dispute with the landlord, for example about a rent reduction (Mietminderung), is covered under property legal cover as tenant. Whether a direct dispute with the neighbour is included depends on the tariff.

Many conflicts can be settled by talking or at the local arbitrator (Schiedsperson). If you rarely have trouble and plan no building work, you do not strictly need the property module. With a dispute already simmering, new insurance will not help anyway.

Step by step

  1. Talk first and record the conflict with photos and dates.
  2. Check whether you have property legal cover for that home.
  3. Establish when the dispute began: after the start and the waiting period?
  4. Report the case to the insurer and ask for cover for advice and conciliation.
  5. Find out whether your state requires conciliation before a lawsuit.

Checklist

  • Property legal cover in the policy
  • Property and capacity correctly stated in the policy
  • Dispute arose after the start and the waiting period
  • No building project as the trigger
  • Mandatory conciliation in your state checked
  • Evidence collected: photos, noise log, witnesses

Common mistakes

  • Taking out insurance only once the dispute is already simmering
  • Having private legal cover without the property module
  • Suing without conciliation where it is mandatory
  • Assuming a dispute about your own building work is covered
