What does legal expenses insurance cover in Germany?

In short

German legal expenses insurance (Rechtsschutzversicherung) is not one product but a set of modules. The four main ones are private life, work, traffic and tenancy. Optional extras cover tax law, social law, criminal law for negligence only, data protection, plus inheritance and family law, usually as advice only. What matters is not the word Rechtsschutz but which modules your policy names.

The four core modules and what they cost

German insurers build legal cover like a toolbox. Each module covers exactly one area of life, and whatever is not in the policy is not paid. If you only hold traffic cover and then fall out with your employer, you have no cover at all.

The prices in the table are shares of the total premium. Traffic and tenancy can be bought on their own from many insurers, the work module almost never: it is the most expensive part and normally comes bundled with private cover.

Tenancy cover: tenant and landlord are two different things

The housing module is often simply called Mietrechtsschutz, but in its basic form it only covers the tenant against the landlord. Arguments about the service charge statement (Nebenkostenabrechnung), about mould, about a rent increase or about notice to quit are included.

If you let out a flat yourself, you need a separate module. It costs considerably more and the premium rises with every unit. Owners who live in their own flat and let nothing often do not need the housing module at all: disputes with tradespeople already sit inside private cover.

The extras, honestly assessed

Tax cover only starts at the tax court (Finanzgericht), not at the objection stage with the tax office. Social law cover pays for the social court, for example when a care level is set too low. Criminal cover applies to negligence only: for intent the policy pays nothing, and if negligence turns into intent during the case, you have to pay the money back.

Data protection cover sounds modern but rarely leads to proceedings. Inheritance and family law are almost always covered as advice only, meaning a conversation with a lawyer, not a court case. Anyone buying a policy because of an inheritance dispute or a divorce will be disappointed.

What the policy actually pays

It covers your lawyer's fees, court fees, experts and surveyors, witness expenses, translations and travel to the hearing. If you lose the case, the policy also pays the other side's lawyer. Many tariffs additionally pay for mediation, an agreement reached with a neutral third party instead of a judgment.

The limit matters: what is reimbursed are the statutory fees under the German lawyers' fee act (Rechtsanwaltsvergütungsgesetz), calculated from the value in dispute. If your lawyer agrees an hourly rate above that, you pay the difference. Fines, criminal penalties and the disputed amount itself are never covered.

The waiting period and when cover really starts

Most modules carry a waiting period (Wartezeit) of three months. It applies to employment, tenancy, contract, tax and social law. A dispute that begins inside those three months is not covered, even if you only instruct a lawyer later.

Traffic cover, damage claims after an accident and criminal cover usually have no waiting period. If you switch from another legal expenses policy without a gap, the waiting period is normally credited: the new insurer accepts the time served with the old one.

Which modules most people do not need

Landlord cover is pointless if you let nothing. Tax cover almost never helps an employee with a simple tax return. Data protection cover is, in many tariffs, more of a shop window than a benefit.

On the work module: union members already get legal support in employment matters through their union, and civil servants rarely end up at the labour court. If you drive nothing at all, not even a pedelec, you can drop the traffic module, but you also lose the cover you would have as a cyclist, pedestrian or passenger after an accident.

  1. Write down where disputes can realistically arise: job, flat, vehicle, contracts, authorities.
  2. Go through the four core modules one by one and take only those that match your life.
  3. For the extras, check the wording: is it full cover for court, or advice only?
  4. Compare the cover limit, the deductible and the waiting period, not just the price.
  5. Put quotes with exactly the same modules side by side and ask for the policy wording.

  • Signing up shortly before a foreseeable dispute and overlooking the three month waiting period

Frequently asked

Is employment law always included?

No. You need the work module (Berufsrechtsschutz). It is the dearest part and is usually sold only together with private cover.

Does the policy pay the other side's lawyer?

Yes. If you lose, it covers the opposing lawyer as well as your own and the court, up to the statutory fee scale.

Is mediation covered?

In many tariffs yes, often with its own limit per case. It is worth using, because an agreement is usually faster and cheaper than a judgment.

Does cover extend to my family?

In a family tariff yes. It normally includes your spouse or registered partner in the same household and unmarried children until they finish their first vocational training.

Can I get the policy and the service in English?

Some insurers offer English service, many do not. The German wording is what counts in a claim, so ask us when a clause is unclear.

What about a dispute over building my own house?

Building disputes on your own property are excluded almost everywhere, even with housing cover. Here only a careful contract review beforehand helps.
