Drone insurance in Germany: compulsory for every drone, even the smallest

German aviation law requires the keeper of any unmanned aircraft to hold liability insurance, whatever its weight and whether you fly for fun or for money. This is stricter than in many countries, where small drones are exempt. Many German personal liability policies include drones, but only for private use and only up to a weight limit.

The question almost everyone asks first

Do I need insurance to fly a drone in Germany?

Yes. The German Aviation Act makes liability insurance compulsory for every drone flown outdoors, including models under 250 grams and purely recreational flights. For drones under 500 kilograms, EU law sets the minimum cover at 750,000 Special Drawing Rights, roughly EUR 900,000. Your personal liability policy may already meet this if it names drones explicitly and confirms cover under the Aviation Act. For any paid work you need a separate commercial drone policy.

Strict liability and why Germany insists on insurance

Under the German Aviation Act, whoever keeps an aircraft is liable for damage it causes to third parties even without any fault, for example after a software glitch or a sudden gust of wind. Drones are aircraft in this sense, so a crash onto a car or a person is your financial responsibility whatever the cause.

Because of this strict liability, insurance is compulsory for every drone. The weight threshold of 250 grams that you may know from EU rules concerns registration and pilot competence, not insurance. Flying uninsured is an administrative offence and leaves you personally liable.

Personal liability or a dedicated drone policy

Many modern German personal liability policies, called Privathaftpflicht, include drones up to a take-off weight such as 250 grams, 2 kilograms or 5 kilograms. Check three things: that drones are named explicitly, that the policy confirms compulsory cover under the Aviation Act, and that your use is private. Ask for a written insurance confirmation and carry it when flying.

Selling a single photo, filming for a client or inspecting a roof for money counts as commercial use. Privathaftpflicht will not pay, and you need a commercial drone policy, often combined with hull cover for the aircraft.

EU rules on top of insurance

Since 2021 the EU drone rules apply in Germany. Operators register with the Luftfahrt-Bundesamt if their drone weighs 250 grams or more or carries a camera, unless it is a toy, and display the registration number as an e-ID on the drone. An EU registration from another member state is valid in Germany, so you do not need to register twice.

From 250 grams you also need the EU online competency certificate for subcategories A1 and A3, and the remote pilot certificate for A2. Insurers ask about these after an accident, and flying without the required certificate can lead to recourse against you.

  6. Neighbours sue over filming, legal fees. Budget policy: does not pay, Strong policy: does not pay. Privacy and injunction claims are not property or personal injury. No drone policy pays for them.

What it costs

For hobby pilots, drone cover is often already part of personal liability or a cheap add-on. Commercial policies cost more and vary widely by operation type, weight and cover.
