What does a pre-existing dispute mean in German legal expenses insurance?
In short
A pre-existing dispute (Vorvertraglichkeit) in German legal expenses insurance means the cause of the conflict lies before your cover started, so the insurer does not pay. What counts is usually the first breach of a legal duty, not the day you see a lawyer. Many areas also have a 3 month waiting period. You cannot insure a dispute you already know about.
What legal expenses cover costs in Germany and what a dispute can cost without it.
Example
Typical range
Family, private, work, traffic and housing, EUR 150 excess
about EUR 251 to 978 a year
First consultation with a lawyer without fee agreement, consumer
EUR 190 plus VAT at most
Unfair dismissal claim at EUR 5,000 gross salary, first instance
at least about EUR 2,900 own lawyer fees
Further advice or written opinion, consumer
EUR 250 at most
Premiums from a published tariff comparison, 2026.
Fees under section 34 RVG.
In the first instance before a German labour court each side pays its own lawyer (section 12a
ArbGG).
Worked example
Written warning before cover, dismissal afterwards
An employee takes out legal expenses cover including employment law. Her employer had already given her a written warning.
Written warning for an alleged breach
10 February
Start of cover
1 March
Dismissal referring to the warning
20 July
First breach under the terms
10 February, before cover started
No cover: the dismissal rests on a breach from before the policy. Had the warning come after 1 June, the case would have been covered.
When the insured event happens
German legal expenses insurance (Rechtsschutzversicherung) only pays for cases that arise after your cover begins. What matters is not when the dispute escalates but when it counts as having started under the policy terms. That is the core of a pre-existing dispute.
The model terms of the German insurers' association use three key dates. If a breach lasts over a period, its beginning counts.
Area
Key date
Example
Damages claims
the event that caused the damage
a cycling accident
Advice on family and inheritance law
the change in your legal situation
death of a relative
All other areas
the first breach of a legal duty
wrong service charge bill, written warning
The first breach decides
If several breaches led to your dispute, the first one counts. If it happened before your legal expenses cover began, there is no cover, even if the lawsuit only starts months later. Rental disputes that begin with a wrong bill from the previous year are a typical case.
Some policies ignore breaches that happened more than one year before cover started. In the model terms this clause is only optional, so check your policy wording.
Applications and notices given before cover starts
A pre-existing dispute can exist without any breach. Under the model terms there is no cover if, before the start date, you applied to an authority, for example for a disability assessment, or claimed benefits under another policy, such as a disability pension.
An optional clause also excludes cases where you gave notice on a contract before cover started and the dispute relates to its end. Classic example: you give notice on your flat and later argue about the deposit.
The waiting period is something else
The waiting period (Wartezeit) comes on top. If the insured event happens in the first three months, it is not covered even if its cause lies after you signed. Under the model terms, damages claims, criminal and regulatory offence cases and advice on family and inheritance law are exempt.
Whether a new insurer waives the waiting period when you switch without a gap depends on its policy wording. Ask before cancelling your old legal expenses policy.
After the policy ends
A case that arose while you were insured stays covered even if you report it after the policy ends. Under the model terms, cover lapses if you report it more than three years after your cover for that area ended.
When you switch, the old insurer is therefore often responsible for disputes whose cause lies in its time. This is the other side of the pre-existing dispute rule and protects you from a gap.
Step by step
Write down when the trouble first started: letter, bill, warning, accident.
Compare that date with the start of cover and the end of the waiting period.
Before signing, check whether the policy has the one year clause.
When switching, clarify which insurer is responsible for older causes.
Ask for written confirmation of cover (Deckungszusage) before hiring a lawyer.

Questions and answers
Frequently asked
What does pre-existing mean in legal expenses insurance?
The cause of the dispute lies before your cover started.
Then the insurer does not pay, even if the court case begins later.
Can I insure a dispute that is already running?
No.
If you know at signing that the insured event has already happened,
the insurer owes nothing under section 2(2) VVG.
Does the day I see a lawyer count?
No.
Usually the first breach of a legal duty counts,
for damages claims the event that caused the damage.
Do I have to disclose old disputes when applying?
You must answer the questions the insurer asks in writing.
Wrong answers put the whole policy at risk.
Does a policy without waiting period help?
It helps against the waiting period, not against a pre-existing dispute.
If the cause lies before the start, the case stays uncovered.
