How much does a lawyer cost in Germany without legal insurance?
In short
Without legal insurance, a lawyer in Germany costs at most EUR 226.10 including VAT for a first consultation. A lawyer's letter in a EUR 5,000 dispute costs about EUR 572. If you lose a EUR 5,000 lawsuit, you pay both lawyers and the court, about EUR 2,670 in total. In employment cases each side pays its own lawyer at first instance, even the winner.
Statutory fees under the RVG and the Court Fees Act as amended from 1 June 2025, calculated with the EUR 20 expenses flat rate and 19 percent VAT.

How German lawyers charge: the RVG
Unless you agree otherwise, fees follow the Lawyers' Remuneration Act (RVG). They depend on the amount in dispute. Since the increase on 1 June 2025, one full fee is EUR 51.50 for up to EUR 500, EUR 354.50 for EUR 5,000 and EUR 652 for EUR 10,000.
Depending on the work, a multiple of that fee applies. A letter outside court is usually 1.3 times the fee; more is only allowed if the matter was extensive or difficult. In court, 1.3 for the proceedings and 1.2 for the hearing add up. On top come a EUR 20 expenses flat rate and 19 percent VAT.

The real risk: losing
In a German civil case the loser pays the costs: their own lawyer, the other side's lawyer and the court fees. For EUR 5,000 the court fee for the proceedings is EUR 511.50, for EUR 10,000 it is EUR 849.
If you win in part, costs are split in proportion. Expert witnesses and witness expenses come on top and can quickly reach several thousand euros in building or medical disputes.
Employment law: you pay even if you win
At the labour court of first instance, even the winning side does not get its lawyer's fees back. Your lawyer must tell you this before you sign.
For an unfair dismissal claim the value is at most three months' salary. At EUR 3,500 gross a month that is EUR 10,500. A severance payment is not added.
Hourly fees and flat fees
Many firms agree an hourly fee instead of the statutory fees. According to a survey by the Federal Bar for 2024, the usual hourly rate averaged EUR 244 net. Ask in writing how many hours the firm expects. English speaking lawyers are common in the cities but do not charge less.
In court the other side only reimburses statutory fees, not a higher hourly fee. You keep the difference, even if you win.
When you do not need legal insurance
On a low income you can get advisory assistance (Beratungshilfe) from the local court and pay the lawyer no more than EUR 15; the fee can even be waived. For a lawsuit, legal aid (Prozesskostenhilfe) can cover your own costs, but not the other side's costs if you lose.
Legal insurance pays off mainly for employees, tenants and drivers, because disputes there are frequent and costs can remain even after a win. If you rarely go to court and have a few thousand euros in reserve, you can carry the risk yourself.
Step by step
Work out the amount in dispute.
Ask about costs at the first meeting; a consumer's first consultation is capped at EUR 190 net.
On a low income, apply for advisory assistance at the local court first.
With an hourly fee, put the rate and the expected hours in writing.
Before suing, calculate the full risk: two lawyers plus the court.
