Does legal expenses insurance pay for a service charge dispute in Germany?
In short
Yes, legal expenses insurance does pay for a service charge dispute in Germany if you have the housing module (Wohnen) and the disputed statement arrived after the waiting period of usually three months. On an extra EUR 800 claimed, losing in court without cover costs around EUR 785. Your deductible of often EUR 150 to 250 is your own, so for small sums a tenants' association is often enough.
What the cover costs and what a service charge dispute in Germany can cost without it.

Worked example
Extra payment of EUR 780, landlord sues
A tenant is asked to pay EUR 780 extra. The statement includes lift repairs and inflated garden maintenance. He objects in writing, the landlord sues. He has had legal cover with the housing module for four years and a EUR 150 deductible.
Value in dispute
EUR 780
Court fees at first instance
EUR 183
His own lawyer
about EUR 301
Landlord's lawyer if he loses
about EUR 301
With legal insurance he pays
EUR 150 deductible
Without insurance, if he loses
about EUR 785 plus the EUR 780
With the housing module the dispute costs him EUR 150 whatever the outcome. Without cover, losing would cost around EUR 1,565. Calculation with guide values.
When German legal insurance pays in a service charge dispute
Service charges (Nebenkosten or Betriebskosten) are part of your tenancy agreement. A dispute about them is covered only by the housing module, also called tenancy legal cover. Private or employment cover alone does not help. The module covers the address named in your policy.
The second condition is the waiting period of usually three months. The third is timing: the dispute normally starts with the faulty statement you object to. If it arrived before your policy began or during the waiting period, the insurer will usually refuse. Get a confirmation of cover (Deckungszusage) before you hire a lawyer; if the insurer sees little chance of success it can decline.

What a service charge dispute costs in court
The value in dispute is usually the amount you contest. Court and lawyer fees in Germany are set by statute based on that value. At first instance there are three court fees plus, for each lawyer, a procedure fee and a hearing fee. The loser usually pays everything, including the other side's lawyer.
Measured against the small sums, that is a lot: at EUR 500 in dispute the risk is about EUR 476, at EUR 1,000 about EUR 785. A settlement makes it cheaper. With legal insurance you only pay your deductible, however the service charge dispute ends.

Check first, then dispute
Under section 556 (3) of the German Civil Code (BGB) your landlord must send the statement no later than twelve months after the end of the billing period, otherwise they usually cannot claim any extra payment. You have twelve months from receipt to raise objections; after that they are generally excluded.
Typical errors are repairs billed as caretaker costs, a wrong allocation key, unexplained items such as other costs, and vacant flats spread over the remaining tenants. For comparison, the tenants' association's operating cost index for 2024 data shows an average of EUR 2.67 per square metre a month. Ask in writing to see the receipts (Belegeinsicht) before you start a dispute.
Legal insurance or a tenants' association
A tenants' association (Mieterverein) costs about EUR 50 to 100 a year and advises without a waiting period. For a service charge statement that is often exactly right: its advisers know the usual errors and write to your landlord, in German. Some associations offer legal cover through a partner, which also has a waiting period.
Legal insurance comes into its own when the case goes to court or grows, for example with several years of extra payments or a parallel dispute about defects. With the housing module it costs about EUR 200 a year for a single person.
When legal insurance is not worth it
If EUR 150 is in dispute and your deductible is EUR 250, the insurer pays practically nothing. A tenants' association or your own letter to the landlord is the better route.
Taking out a policy because of a statement you already have will not cover that case. And reporting several cases in a short time may lead the insurer to cancel. For frequent small disputes, the association is usually cheaper.
Step by step
Check the statement for deadline, period, allocation key and single items.
Ask in writing to see the receipts.
Raise objections in writing within twelve months of receipt.
Get a confirmation of cover from your insurer before hiring a lawyer.
Pay only the undisputed part, if in doubt under reservation.
For small amounts, ask a tenants' association instead of using your policy.

Questions and answers
Frequently asked
Does private legal cover alone include service charge disputes?
No.
Disputes from your tenancy are only covered by the housing module.
What if the statement arrives late?
If it comes more than twelve months after the end of the billing period,
the landlord usually cannot claim extra payments.
A credit must still be paid out to you.
Can I withhold the extra payment?
Often the disputed part, especially if the landlord refuses to show the receipts.
Get advice first so you do not fall into arrears.
Do I need to speak German for this?
Statements, letters and court proceedings are in German.
A tenants' association or lawyer can handle the correspondence;
many lawyers also advise in English.
Is instant legal cover without a waiting period worth it?
It does not pay for a dispute that has already started either.
It only saves the waiting period for future cases and usually costs clearly more.
