Does legal expenses insurance help with mould in a rented flat?
In short
Yes, legal expenses insurance does help with mould in a rented flat if you have the tenancy module (Baustein Wohnen), the waiting period of usually three months is over and the dispute began after it. It pays your lawyer, the court and court-appointed experts, minus your deductible of often EUR 150 to 300. A mould survey you order yourself is usually not covered.
What the cover costs and what a mould dispute without insurance can cost.

How insurers fix the start of a mould dispute depends on your policy terms;
the refusal when mould was reported earlier is a guide value from our quoting practice.

Worked example
Mould in the bedroom, landlord blames your airing
A tenant pays EUR 900 rent a month. She has had legal insurance with the tenancy module and a EUR 150 deductible for three years. In November mould appears on the outside wall of the bedroom. She reports it in writing, the landlord refuses. She reduces the rent by an assumed 15 percent and the landlord sues for the arrears.
Reduction of 15 percent of EUR 900
EUR 135 a month
Amount open after eight months
EUR 1,080
Lawyer, court, landlord's lawyer if she loses, value in dispute around EUR 1,500
about EUR 1,100
Court-appointed survey on the cause
about EUR 800 to 900 or more
With legal insurance she pays
EUR 150 deductible
Without legal insurance she pays if she loses
about EUR 1,900 to 2,000 plus the arrears
With the tenancy module the dispute costs her EUR 150, whatever the outcome. Without it she risks around EUR 2,000 in costs, which equals the premium for the module over many years.
When legal insurance pays in a mould dispute
A dispute about mould is a dispute under your tenancy agreement. For that you need the tenancy module of legal expenses insurance (Rechtsschutzversicherung), often called Wohnen, Mietrecht or Wohnungsrechtsschutz. It covers the flat named in the policy, so report a new address when you move.
The second condition is the waiting period, three months in most policies. The third is timing: the insurer asks when the breach began that you rely on. If that was before the policy started or during the waiting period, for instance because you had reported the mould long ago and the landlord did nothing, it often refuses.
Situation
Does legal insurance pay?
Tenancy module for two years, new mould, landlord refuses to act
yes, after cover confirmation
Policy taken out a month ago, mould found now
usually no, waiting period still running
Mould reported last winter, policy taken out afterwards
usually no, the dispute began before the policy
Only private and work cover, no tenancy module
no
Landlord sues for arrears because you reduced the rent
yes, if the conditions above are met
Your own survey before the dispute
usually no
Damage to furniture and clothes from mould
legal insurance pays only the lawyer, not the damage itself
What legal insurance pays and what it does not
Once the insurer confirms cover (Deckungszusage), it pays your lawyer under the statutory fee scale, the court fees, a court-appointed expert and, if you lose, the landlord's lawyer. You pay your deductible yourself, usually EUR 150 to 300 per case.
A survey you order yourself is usually not refunded, even if it helps later in court. The insurance ombudsman has confirmed this approach. Legal insurance also does not pay for repairs, damaged furniture or doctors; it only handles the legal dispute. You can claim damaged furniture from the landlord if he is to blame for the defect, and that dispute is covered again.
How to enforce your rights as a tenant
Under the German Civil Code (§ 536c BGB) you must report a defect to the landlord without delay. If you do not, and he could not react because of that, you lose the right to reduce the rent for that period and may be liable for further damage. Report mould in writing, with photos, the date and a deadline for repairs.
If the mould limits the use of the flat, the rent is reduced by law (§ 536 BGB). How much depends on the extent: guides mention about 10 to 25 percent for light mould, around 30 percent for bathroom and bedroom together and up to 80 percent for soaked living rooms. If in doubt, keep paying under reservation (unter Vorbehalt) rather than cutting too much; reducing too much can lead to termination for arrears.
The real question: ventilation or building defect
Almost every mould dispute is about the cause. The landlord says you did not air and heat properly. The tenant says it is a thermal bridge, a leaking roof or rising damp. This rarely gets settled without an expert, which makes court cases expensive and slow.
A survey to secure evidence costs about EUR 350 to 500, a full survey about EUR 800 to 900. This is where legal insurance shows its value: in court the judge appoints an expert, and the insurer then pays for that expert.
When you do not need legal insurance
If the landlord deals with the mould quickly after your report, you need no lawyer. If the mould is small and clearly caused by your own habits, say behind a wardrobe on an outside wall, a dispute is not worth it.
If you only need reliable advice, a tenants' association (Mieterverein) for about EUR 60 to 100 a year is often enough; many offer legal cover for members with its own waiting period. If you already have mould, no new policy will cover that dispute. Taking out cover can still make sense for future disputes.
Step by step
Photograph the mould, measure the area and note the date.
Report the defect to the landlord in writing and set a deadline for repairs.
Record your airing and heating, for example with a thermometer that shows humidity.
Get cover confirmation from your legal insurer before hiring a lawyer.
Only then reduce the rent, and if in doubt keep paying under reservation.
Order your own survey only if you are prepared to pay for it yourself.

One ordered by the court, yes; one you order yourself, usually not.
Clarify this with the insurer before you commission it.

You can take it out, but it usually will not pay for this mould dispute.
It only helps with future disputes after the waiting period.

Tenancy disputes are covered only through the tenancy module in most policies.
How much can I reduce the rent for mould?
It depends on the extent.
Guides mention about 10 to 25 percent for light mould and much more for soaked living rooms.

Does legal insurance help if my landlord blames me?
Yes, defending against the landlord's claims under the lease is also covered by the tenancy
module, for example for removal or redecoration costs.
Is a tenants' association cheaper than legal insurance?
For advice often yes, at about EUR 60 to 100 a year.
For a court case it depends on whether the association includes legal cover for members and what
