Does legal expenses insurance pay in criminal proceedings in Germany?

Legal expenses insurance in Germany does pay in criminal proceedings, but only within narrow limits: if you are accused of a negligent act or of a traffic offence. It does not pay for intentional acts or serious crimes, and if you are finally convicted of intent you must pay the money back. A defence at the local court costs about EUR 1,200 under the statutory fees.

Rear end collision, injured driver, criminal investigation

After a rear end collision the public prosecutor investigates you for negligent bodily injury. The case goes to trial at the local court.

Without a policy about EUR 2,000 to 2,700 are at stake for the defence, with a policy only the deductible. Had it been drink driving with a judgment for intent, you would have to repay everything.

The short rule: negligence yes, intent no

Criminal cover in a standard German legal insurance policy is made for people who made a mistake, not for deliberate acts. It pays your defence if you are accused of acting negligently: a car accident with injuries, a dog that bites someone, a passer by who slips on the icy pavement you should have cleared.

For offences that can only be committed intentionally, the basic cover does not pay at all. That includes fraud, theft, insult or tax evasion. Serious crimes, meaning offences with a minimum sentence of one year in prison, are excluded as well, even if you are acquitted in the end.

Traffic offences: cover first, settlement later

Traffic is a special case. If you are accused of a traffic offence such as drink driving or leaving the scene of an accident, the insurer confirms cover at first, even if the charge says intent. Your lawyer can start straight away.

The settlement comes after the judgment. If it says negligence, or if you are acquitted, the insurer keeps paying. If you are finally convicted of intent, the insurer claims back everything it has paid. Keep that in mind before you hire an expensive defence lawyer.

What a defence costs

German defence lawyers charge under the Lawyers' Remuneration Act (RVG) within fee ranges. Since June 2025 the basic fee is EUR 48 to 432, the procedural fees in the investigation and before the local court EUR 48 to 348 each, and the hearing fee per trial day at the local court EUR 84 to 576. With mid range fees, expenses and VAT a simple case with one hearing comes to about EUR 1,200.

Many defence lawyers work with a fee agreement above the statutory fees. Standard legal insurance only pays the statutory fees; you pay the difference. Ask before you sign.

Extended criminal cover: who needs it

For accusations that can only be committed intentionally there is extended or special criminal cover. It pays your defence even against an intent charge, often including agreed fees up to a limit. If you are finally convicted of an intentional act, you still have to pay back.

It makes sense mainly for people with responsibility at work: managing directors, site managers, doctors, nurses, trainers, staff in environmental protection or accounting. Investigations there often grow out of daily work. For most private individuals the basic cover in the private or traffic module is enough.

When you do not need the module

A separate criminal policy does not pay off if you already have a package with private, work and traffic cover, because defence against negligence charges is usually included there. Nor does it help for something that has already happened: anything before the start of the contract is never covered.

To be honest, criminal proceedings are rare for most people. The real value lies in traffic, where an accident with injuries quickly leads to an investigation, and at work if you are responsible for others.

  1. Check your policy schedule for criminal cover and for which areas of life it applies.
  2. Get confirmation of cover before you instruct a lawyer, ideally through the lawyer.
  3. Ask the lawyer whether they charge statutory fees or work with a fee agreement.
  4. For traffic charges, remember that payment is provisional and depends on the judgment.
  5. If you carry responsibility at work, look at extended criminal cover.

What is the difference between Vergehen and Verbrechen?

A Verbrechen is an offence with a minimum sentence of one year in prison; everything below is a Vergehen. Legal insurance does not pay for a Verbrechen.

Does the insurer pay my fine?

No. Fines, court ordered payments and administrative fines always stay with you. Only the cost of the defence and the proceedings is covered.

What happens with drink driving?

The insurer covers you at first. If you are convicted of negligent drink driving, that stays. If the judgment says intent, you must pay the costs back.

Can I choose my own defence lawyer?

Yes, you can instruct a lawyer of your choice. The insurer usually pays that lawyer's statutory fees, higher agreed fees only under extended cover.

Does the policy help if I am the victim of a crime?

It depends on the policy. Many newer terms include victim protection that pays a lawyer for joining the prosecution as a co-plaintiff. Check your terms.
