A stray ball hits a parked car, the ride-on mower catches fire, the clubhouse runs its own restaurant: a golf course is a sports venue, a machinery fleet and a host all at once. Since the blanket cover that used to come with membership of the German Golf Association lapsed in 2022, every course has had to put its own protection together. Here is which lines belong to that cover and what they cost, for course operators in Germany.
The question almost everyone asks first
In principle the player who hit the shot. Because the player often cannot be identified, or their own personal liability cover disputes the claim, in practice it is regularly the course operator's business liability that has to step in, where a hole is laid out too close to public land or neighbouring property without adequate safeguards such as ball-stop fencing. German courts treat this as a breach of the operator's duty of care.
A tee shot clears the boundary fence and dents a parked car or hits a passer-by. This happens most often on holes that run close to roads or neighbouring land.
A cracked paving slab on a path, a loose step to the terrace, a tree that comes down in a storm: the operator must keep paths, grounds and planting safe, and is otherwise liable for falls and accidents.
The ride-on mower, roller and irrigation control system are expensive and run almost daily. A breakdown or fire stops course maintenance in its tracks and can easily run into five figures.
A kitchen fire, a water leak in the cellar, a guest slipping on a wet terrace: a clubhouse with its own restaurant brings its own building and operating risks.
A hired golf cart collides with a player or tips over on a slope. Depending on its type and registration, the vehicle may need its own motor liability cover, which a general business or personal policy does not automatically include.
Where the course is run as a registered association, the voluntary board can be personally liable for serious mistakes in bookkeeping, tax or contracts unless a D&O policy is in place.
