Who pays if a young person from our residential group damages something?

First the young person, if they have their own liability insurance, which is rare. A claim against your organisation only exists if supervision was inadequate. Practical tips from your broker

  1. Make sure damage caused by clients is expressly included even when your organisation is not at fault, with a limit that suits the people you support.
  2. Include damage to all rented flats and premises and the loss of keys in your liability policy.
  3. Check your service agreements with the youth welfare office and other funding bodies for the minimum sums insured they require.
  4. Cover staff members' own cars on work trips with business travel insurance for their vehicles.
  5. Protect social data with two-factor login and off-site backups; many cyber insurers make this a condition.
  6. Always report assaults by clients to the BGW, even without visible injury: psychological effects can appear later.

Does a youth welfare provider in Germany have to be insured?

There is no general legal duty, but in practice the operating licence and service agreements assume liability cover. Vehicles need compulsory motor liability insurance.

Is our organisation liable for damage caused by the young people we look after?

Only if supervision was inadequate. Otherwise many injured parties are left with the cost. An extension for damage caused by clients pays up to a set limit even when you were not at fault.

Are our volunteers covered for accidents?

In the welfare sector, yes, through the BGW, the statutory accident insurer. For their liability, your public liability policy should name volunteers as insured persons.

Does an advice centre need professional indemnity cover?

Yes, if it gives advice on legal or financial matters such as debt, welfare benefits or tenancy law. Wrong information can cost clients money.

What does insurance for a residential group cost?

Liability cover including damage caused by clients is usually about 500 to 1,200 euros a year. With D&O, contents and cyber it comes to about 1,500 to 3,200 euros.

Who pays if a staff member drives a client in their own car?

Damage to others is paid by the staff member's own motor liability insurance. Damage to their own car is only covered if your organisation has business travel cover for staff vehicles; otherwise the staff member bears it.
