What is the difference between an e-bike and a pedelec?

A pedelec assists only while you pedal, with a rated continuous power of at most 250 watts and up to 25 km/h. German law treats it as a bicycle: no plate, no licence, no helmet duty, cycle paths allowed. A real e-bike has a throttle and moves without pedalling, an S-pedelec assists up to 45 km/h. The pedelec stays a bicycle and costs only the voluntary theft cover. The S-pedelec is faster but brings a plate, a helmet and a duty to ride on the road, and the premium is higher. Worked example with guide values.

The three classes and how to tell them apart

In shops almost anything with a motor is called an e-bike. In law there are three classes, and you recognise them by two numbers and one question. The numbers are on the type plate or in the manual: the rated continuous power in watts and the speed at which the motor cuts out.

The question is whether the motor drives the bike when you are not pedalling. On a pedelec it does not, apart from a walk assist up to 6 km/h. A real e-bike has a throttle and moves without pedal work, which takes it out of the bicycle class entirely.

Why the classification decides everything

The class determines every duty: insurance plate, driving licence, helmet, minimum age and where you are allowed to ride. It also decides which insurance is responsible after an accident.

Cross the limit and you lose bicycle status completely. You are then riding an unregistered, uninsured motor vehicle without the right licence. That is not a formality in Germany, it breaches the compulsory insurance act (Pflichtversicherungsgesetz).

Pedelec: a bicycle in the eyes of the law

As long as the motor has at most 250 watts of rated continuous power, only helps while you pedal and cuts out at 25 km/h, German traffic law treats your pedelec as a bicycle. No plate, no registration, no licence, no helmet duty. You may use cycle paths and must use them where they are compulsory.

For liability you are a cyclist, not a driver. If you hit someone, your personal liability policy (Privathaftpflichtversicherung) pays. Check that pedelecs are named in the wording, because older contracts do not always mention them.

S-pedelec and real e-bike: a motor vehicle with duties

An S-pedelec assists up to 45 km/h and is therefore a light moped. Before your first ride you need an insurance plate (Versicherungskennzeichen), at least a class AM licence and an approved helmet. Cycle paths are off limits, the S-pedelec belongs on the road. A few federal states allow exceptions, but only where it is signposted.

A real e-bike with a throttle moves without pedalling and is a Mofa or a light moped depending on its top speed. For the 20 km/h version a Mofa certificate is usually enough; for the fast version the S-pedelec rules apply. The helmet is mandatory here too, and in town you may use a cycle path only with an extra sign.

What it means for theft, liability and damage cover

On a pedelec everything stays in the bicycle world: theft through contents insurance (Hausratversicherung) with a bike add-on or a separate bike policy, liability through your personal liability policy, damage to the bike only through a separate policy.

With an S-pedelec or a throttle e-bike everything moves into the motor world. Liability cover is compulsory and comes with the insurance plate. Theft and damage to the vehicle are added as partial or full comprehensive cover (Teilkasko, Vollkasko) on the same policy.

Tuning ends the bicycle status

A stronger motor, a removed speed limit or a tuning module turns a pedelec into a motor vehicle in law. From that moment the type approval, the plate and the compulsory insurance are missing, and your personal liability policy no longer applies.

This is the most expensive mistake in this topic. If you count as the keeper of an uninsured motor vehicle after a crash, you carry the damage yourself. Leave the power as the manufacturer set it.

Step by step

  1. Read the type plate or the manual: rated continuous power in watts and the cut-out speed are printed there.
  2. Check whether the motor drives the bike without pedalling. If it does, it is not a pedelec.
  3. At 250 watts and 25 km/h: check that your personal liability policy names pedelecs and choose theft cover.
  4. At 45 km/h or with a throttle: get the insurance plate before the first ride and have the licence and helmet ready.
  5. Do not fit any power upgrade, or the bicycle status and all its freedoms are gone.

Yes. On a pedelec the rules for cyclists apply; on an S-pedelec or throttle e-bike the stricter rules for motor vehicles apply.
