Do you need builder's liability insurance in Germany?

In short

Yes, if you are the one commissioning the build or a major renovation. As the owner of the project (Bauherr) you are liable for a safe site, even when contractors do the work. For a family home it usually costs a one-off EUR 100 to 400 for the whole build. You don't need it if you buy from a developer (Bauträger) or the job stays within your personal liability policy.

About EUR 400 for the entire build, roughly 0.1 percent of the cost. One injured passer-by can cost many times that.

Why the owner is liable

German courts expect whoever creates a hazard to keep others safe from it. For a building site that means fencing, barriers, lighting, warning signs and clearing snow and ice in winter. This is called Verkehrssicherungspflicht.

Hiring contractors does not hand this duty over completely. You have to choose competent firms and check now and then that the site is secured. If a child falls into an open trench at night, the claim often lands with you first.

Who needs it and who doesn't

You need it for a new build with an architect, a prefab house or a general contractor, because in all these cases you remain the Bauherr. The same goes for large renovations, extensions and demolition.

You don't need it when you buy a new home from a developer. The developer is the Bauherr until handover. Small jobs such as a carport or a new bathroom are often covered by your personal liability policy, commonly up to a building cost of EUR 50,000. Check the limit in your policy wording.

What it pays and what it doesn't

It pays for harm your site causes to others: an injured passer-by, a car damaged by scaffolding, cracks in the neighbour's house. It also fights unjustified claims, in court if needed.

It does not pay for damage to your own shell from storm or fire, that needs construction all-risk (Bauleistungsversicherung) and shell fire cover. If friends helping you get hurt, that is for the statutory accident insurance of the construction trade association (BG BAU), where you have to register private helpers.

What to watch when you sign

State the full building cost honestly, including the value of your own work. Many policies include DIY work only up to about EUR 25,000, above that it has to be written into the contract.

Sign before the first digger arrives, since earthworks and demolition already count. Make sure the empty plot is covered until construction starts.

Not by law. Banks, building contracts or the local authority often ask for proof, and without it you are liable with your own assets.

Is my personal liability insurance enough?

For small jobs, often yes. Many policies cover building work up to EUR 50,000, some more. For a new house it is not enough.

Do I need it when buying from a developer?

No. The developer is the Bauherr until handover. Ask for confirmation in the contract that the developer is insured.

Are friends who help me covered?

Damage they cause to others usually is. If they get hurt themselves, the statutory accident insurance applies once you have registered them with BG BAU.

What if construction takes longer?

Most policies run up to two years. If it takes longer, you can extend for a small surcharge. Tell the insurer in good time.

Do I have to cancel it?

No, it ends automatically when the build is finished or on the agreed date.
