Am I liable if someone breaks a leg after I set their ski bindings?

If it can be shown that the binding was set wrongly, yes. Your public liability policy then pays for treatment, lost earnings and compensation for pain and suffering, as long as binding adjustment is insured as an activity. Record the customer's weight, height, ability and the release value you set, and have the customer sign it: in a dispute, that record is your most important evidence.

Practical tips from your broker

  1. Have adjustment work such as ski bindings and your workshop services named explicitly as insured activities.
  2. Include the rental of sports equipment, and check whether motorised items such as e-bikes are part of it.
  3. If you import toys yourself, you need extended products liability for imported goods.
  4. Insure rental equipment and stock at branches and demo days, not only at your main shop.
  5. Agree extra headroom for seasonal peaks in winter sports or Christmas stock.
  6. Record every binding adjustment in writing; without a record, defending a claim becomes difficult.

Frequently asked

Does a sports shop need public liability insurance?

Not by law, but in practice yes. A single accident after a binding adjustment or with rental equipment can lead to claims in the tens of thousands.

How much does insurance cost for a sports shop?

Liability starts at around 80 euros a year. With contents insurance, small shops usually pay between 450 and 1,100 euros, and more with rentals and a workshop.

Is ski rental included?

Not automatically. Rentals must be named in your liability policy, and the rental equipment should be covered by contents insurance away from the shop as well.

Am I liable as a retailer for dangerous toys?

If you import them yourself from outside the EU, you are liable in the same way as the manufacturer. If you buy from a German wholesaler, the wholesaler is usually liable.

Are instruments left for repair insured?

Only if third party property is included. For damage caused while working on an instrument, your liability policy needs cover for items being worked on.

Are demo days and trade fairs covered?

Liability usually applies there too, but the goods are covered only with transit or exhibition insurance. Ask before your first event.
