Who pays if my golf ball damages a car in Germany?

In short

Who pays if my golf ball damages a car in Germany? If you played negligently, you are liable and your personal liability insurance (Privathaftpflicht) pays, as sport is generally covered. A small dent costs about EUR 50 to 150. If you could not see the danger, you are not liable. If the owner parks right by a driving range, they often bear part of it, 20 percent in one ruling.

Worked example

Slice over the driving range fence

Your ball flies over the fence and hits a car in the car park next door. Dent in the roof with paint damage, and the owner plays golf himself and knows the spot.

Repair including paintworkEUR 1,000
Owner's share, as in the Darmstadt ruling20 percent, so EUR 200
Your shareEUR 800
Your personal liability insurance without deductiblepays EUR 800

You pay nothing yourself, the owner bears EUR 200. With a EUR 150 deductible you pay EUR 150 and the insurer EUR 650.

When you are liable

Under section 823(1) of the German Civil Code (BGB), anyone who damages someone else's property intentionally or negligently must pay. A bad shot alone is not enough. What matters is whether you could see the danger and played anyway, for example with a car park or road within reach.

The Regional Court of Düsseldorf dismissed a claim (20 S 132/14) because the ball bounced off a wall the golfer could not see from the tee. If you cannot foresee the danger, you are not acting negligently.

What your liability insurance covers

Standard German personal liability terms cover your legal liability from playing sport, and usually only hunting is excluded. Golf as a hobby is therefore covered, you do not need a separate golf liability policy for it.

Your insurer first checks whether you are liable at all. If the claim is justified, it pays the repair. If it is not, it rejects the claim for you, in court if necessary. That is what happened in the Düsseldorf case.

When the owner shares the cost

Under section 254 BGB, the injured party's own fault reduces their claim. The Regional Court of Darmstadt held a car owner 20 percent responsible after a ball flew over the fence of a driving range (6 S 44/18).

The reasoning: the owner played golf himself and had to know that fences are regularly cleared. Parking right next to a golf facility means accepting part of the risk.

When the golf club pays

The operator has to take reasonable precautions. If it has put up nets, planted trees and set up warning signs, it is usually not liable. The Local Court of Trier dismissed the claim of a company whose car got a dent costing over EUR 1,000 in the club car park (32 C 308/09).

Where such precautions are missing at a spot where balls clearly land often, the outcome can be different. It always depends on the individual case.

When nobody is liable

If the golfer cannot be found or is not at fault, the owner is left with the damage. They can claim on their own fully comprehensive cover (Vollkasko), because a ball strike is a sudden external event and so an accident under the German model terms. Their no-claims rating may then go down.

If only a window is cracked, partial cover (Teilkasko) already pays as glass breakage, without affecting the no-claims rating. For a small dent, claiming on fully comprehensive cover is often not worth it.

Step by step

  1. Find the owner or leave a note with your contact details.
  2. Photograph the damage, the tee and the fence or nets.
  3. Note down witnesses from your group.
  4. Report the damage to your personal liability insurer.
  5. Do not promise to pay before your insurer has checked liability.

Checklist

  • Personal liability insurance covering sport, without a golf exclusion
  • Cover of at least EUR 10 million
  • Owner informed, not just walked away
  • Photos of the damage and the course
  • Owner's share of the blame considered

Common mistakes

  • Leaving the course without telling the owner
  • Offering the owner cash on the spot and skipping the insurer's check
  • Believing the golf club pays for every ball strike
  • Parking next to the driving range as an owner and expecting full payment
