In short
Berufsunfähig (unable to do your occupation) means you can no longer do at least half of the job you last held. Erwerbsgemindert (reduced earning capacity) means you can no longer work more than six hours a day at anything on the open labour market. The state pays only in the second case, on average EUR 1,041 a month. Only private cover closes the first gap.
What the state pays and what the three private designs cost. Private premiums for cover to age 67.
| Example | Typical range |
|---|---|
| State disability pension, new awards in 2024 | about EUR 1,041 a month on average |
| Occupational cover, age 30, office job, EUR 1,500 benefit | about EUR 70 a month |
| Erwerbsunfähigkeit cover, age 30, office job, EUR 1,000 benefit | from about EUR 31 to 39 a month |
| Erwerbsunfähigkeit cover, physically demanding job | about EUR 50 a month, often half the occupational premium |
| Basic abilities cover, EUR 1,000 to 2,000 benefit | from about EUR 31 a month |
The pension figure comes from Deutsche Rentenversicherung (new awards 2024). Premiums as of September 2026 from publicly quoted tariff examples. The distance between the three designs is a guide value from quoting practice; your premium depends on age, occupation and health, and we obtain the exact quote for you.
Worked example
He can no longer do his trade, but he could still work sitting down. Here is how the two systems sit next to each other.
| Net income so far | EUR 2,400 a month |
| Kneeling, lifting, working overhead | permanently impossible, more than 70 percent of his working time |
| Seated work such as stock control | six hours a day would be possible |
| State disability pension | EUR 0, because six hours are possible |
| Agreed private occupational benefit | EUR 1,800 a month, paid |
| If he could manage only four hours | partial state pension, on average about EUR 520, and the private benefit continues alongside |
In this case the state pays nothing and the private policy pays EUR 1,800 a month. Even in the four hour version the two add up: the private benefit is not reduced because the state pays.
Berufsunfähigkeit is a term from a private insurance contract. The measure is the job you last held, exactly as it looked in practice: your tasks, your hours, your responsibility. If you can no longer do at least half of it, and that is expected to last, you are berufsunfähig.
Erwerbsunfähigkeit, which today's law calls Erwerbsminderung, belongs to the state pension system (Deutsche Rentenversicherung). There your occupation does not matter at all. The only question is whether you can still do some kind of work on the open labour market, measured in hours per day. That test is far stricter, and confusing the two words is expensive.
There are two levels. If you can still work three to under six hours a day, you get the partial pension (teilweise Erwerbsminderungsrente), roughly half. Below three hours you get the full one. From six hours upwards you get nothing, no matter which career ends.
There are also qualifying periods: five years of insurance in total, and three years of compulsory contributions in the last five years before the illness. Taking this pension before your regular retirement age costs a deduction of 0.3 percent per month, up to 10.8 percent. Awards are usually time limited, often to three years, and then reviewed again.
| Hours a day you could still work | What the state pension pays |
|---|---|
| six hours or more | nothing |
| three to under six hours | partial pension, roughly half |
| under three hours | full pension |
| three to six hours but no part time job available | in practice often the full pension |
Here is the sentence that decides everything: if you can no longer do the profession you trained for, but you could still work six hours a day at something else, the state pays you nothing. A qualified tradeswoman who could still sit at a checkout after a hand injury is fully fit for work in the eyes of the law and occupationally disabled in the eyes of her contract.
That is exactly the gap a private Berufsunfähigkeitsversicherung closes. It asks about your occupation, not about the labour market. Statutory occupational protection (Berufsschutz) still exists only for people born before 2 January 1961, who can receive a pension when their own occupation and reasonably related work are no longer possible. For everyone younger it was abolished without replacement.
Besides the two terms there is a third design: the Grundfähigkeitsversicherung, or basic abilities policy. It asks neither about your job nor about the labour market, but about single abilities such as sight, hearing, speech, walking, standing, climbing stairs, using your hands or driving. If one of them is permanently lost, it pays, even while you keep working.
That is attractive for manual trades and easier to prove in a claim. The weakness lies elsewhere: mental illness and many internal diseases rarely lead to the loss of one clearly defined ability, and they are the most common reason a working life ends.
| Feature | Berufsunfähig (private) | Erwerbsgemindert (state) | Grundfähigkeit (private) |
|---|---|---|---|
| Measure | the job you last held | any work on the open labour market | loss of single abilities |
| Threshold | 50 percent, expected to last at least six months | under six hours a day partial, under three hours full | one defined ability permanently gone |
| Mental illness | covered when medically documented | covered when the hours no longer work | usually not, or only in part |
| Amount paid | the monthly benefit you agreed | about EUR 1,041 on average, new awards 2024 | the monthly benefit you agreed |
| Premium at 30, office job | about EUR 70 a month for EUR 1,500 benefit | compulsory contribution, not a choice | from about EUR 31 a month |
| Suits | almost anyone living on earned income | basic floor only, it replaces nothing | manual trades when occupational cover is too expensive |
Erwerbsunfähigkeit also exists as a separate private product (Erwerbsunfähigkeitsversicherung). It often costs only about half of comparable occupational cover, and the reason is uncomfortably simple: it pays only when nothing works at all, meaning you cannot do any work above three hours a day for an expected six months or more.
So it makes sense only when a Berufsunfähigkeitsversicherung is not available to you, for example after a pre-existing condition or in an occupation no insurer will write. If you have the choice, take the occupational policy. The lower premium is not an advantage, it is the price of a much higher hurdle.
Many people assume the state system asks whether they can do their own job, the way private income protection does in other countries. It does not. On top of that, the state pension needs five years of insurance and three years of compulsory contributions in the last five years, so someone who started working here two years ago may have no state claim at all.
Policy wording, health questions and claim letters are in German, and the German text is what counts. Answer the health questions completely and in writing; an incomplete answer can void the contract years later. Ask us when a clause is unclear before you sign.
Questions and answers
Almost. Today's law speaks of Erwerbsminderung in two levels. Erwerbsunfähigkeit is the older word and now mainly the name of a private product.
No, not if you could still work six hours a day at something else. Your occupation plays no part in that test.
Only people born before 2 January 1961. For everyone younger, only the open labour market test applies.
Yes, they run alongside each other. The private benefit is not reduced because the state pays.
You probably have no state claim yet, because five years of insurance are required. Private cover is then your only income protection.
For manual trades usually basic abilities, because it pays earlier. If your risk is mental health, erwerbsunfähig cover, because it responds then. Both are second choice.
For new awards in 2024 about EUR 1,041 a month on average, before tax and social contributions. For most people that is far below their last net income.
