Do tinted car windows affect your insurance in Germany?

In short

Do tinted car windows affect your insurance in Germany? Not if only the windows behind the B pillar carry approved film. If the front windows are tinted without approval and that contributed to an accident, your liability insurance still pays the victim but can claim up to EUR 5,000 back from you. Comprehensive cover may reduce payment depending on your fault.

Worked example

Dark film at the front, cyclist missed at night

The front side windows are tinted without approval. Turning at night you miss a cyclist, and the film is found to have contributed.

Cyclist's damage, paid by your liability insuranceEUR 20,000
Insurer's recourse against youup to EUR 5,000
Damage to your own car, comprehensive coverEUR 6,000
50 percent reduction for gross negligenceyou bear EUR 3,000
FineEUR 90 and 1 point

You bear up to EUR 8,090 yourself although both policies were in force. With legal tinting at the rear only, you would have had just your deductible and the no-claims downgrade.

Which tinting is legal in Germany

Under § 40 StVZO, windows that matter for the driver's view must be clear, translucent and free of distortion. That is why the windscreen and the front side windows stay clear. Only a glare strip of up to 10 cm along the top of the windscreen is allowed.

Behind the B pillar you may tint, provided the car has exterior mirrors on both sides. The film needs a general type approval (Allgemeine Bauartgenehmigung, ABG), its test number must be visible on each window and the approval document belongs in the car. Factory tinted original glass is also permitted.

WindowTinting allowed?Consequence if not
Windscreenonly a strip up to 10 cm at the top, approvedvehicle approval may lapse
Front side windowsnovehicle approval may lapse
Rear side windowsyes, film with ABGwithout ABG the approval may lapse
Rear windowyes, with two exterior mirrorswithout ABG the approval may lapse

When the vehicle approval lapses

Under § 19 (2) StVZO the vehicle's operating approval (Betriebserlaubnis) lapses if a modification is expected to endanger other road users. Dark film on the front windows, or film without the right approval, can be exactly that.

Once the approval has lapsed, § 19 (5) StVZO allows the car on public roads only for trips needed to obtain a new approval. Your insurance contract still continues.

What liability insurance pays

Anyone harmed by your car is always paid by your motor liability insurance (Kfz-Haftpflicht). Illegal film, however, counts as an increase in risk. The insurer may then take recourse, meaning it claims money back from you.

Under § 5 (3) KfzPflVV this recourse is capped at EUR 5,000 per person. It requires the film to have caused the accident or the extent of the damage, for example because you missed a cyclist at night through a dark side window.

What comprehensive cover pays

For your own car, § 26 VVG applies: with gross negligence the insurer may reduce payment according to the severity of your fault, with intent it may refuse entirely. There is no EUR 5,000 cap here. If the film had nothing to do with the loss, such as hail or theft, comprehensive cover pays as normal.

Under the model terms the film itself is only covered if it is legal under road traffic law. Nobody will pay for unapproved film when a window is replaced.

When you do not need to worry

If only the rear windows carry film with an ABG or the glass was tinted at the factory, your car complies. Then there is neither a fine nor a gap in your cover.

Still, tell your insurer about later modifications in a short written note. That way nobody can argue later that you kept a change quiet.

Step by step

  1. Check which windows are tinted and whether there is film at the front.
  2. Look for the test number on every tinted window.
  3. Ask the installer for the general type approval and keep it in the car.
  4. Have illegal film at the front removed before you drive on.
  5. Tell your insurer about later modifications in writing.

Checklist

  • Windscreen clear, at most a 10 cm strip at the top
  • Front side windows untinted
  • Rear film with ABG and visible test number
  • ABG document in the glovebox
  • Exterior mirrors on both sides
  • Modification reported to the insurer

Common mistakes

  • Fitting cheap film without approval
  • Believing front tint is fine as long as you can still see through
  • Leaving the approval document at home
  • Not telling the insurer about modifications
