Who is liable for damage at the gym in Germany?

In short

Who is liable for damage at the gym in Germany? The gym, if it breaches its duties, for example by not taking a broken machine out of use; its terms cannot exclude liability for injuries it causes negligently. If you negligently injure another member, your personal liability insurance (Privathaftpflicht) pays, usually EUR 40 to 120 a year. For your own accident without anyone at fault, nobody is liable.

Who is liable for damage at the gym in Germany?

What it costs

Premiums for personal liability insurance in Germany from published tariff examples, plus the usual limit of contents cover outside the home.

ExampleTypical range
Personal liability insurance, singleabout EUR 40 to 120 a year
Personal liability insurance, familyabout EUR 60 to 180 a year
Tariff including rented and borrowed items, singleabout EUR 40 to 120 a year
Contents cover outside the home with EUR 50,000 sum insured and 10 percentat most EUR 5,000

Worked example

Dumbbell hits another member's phone

You put a dumbbell down, it rolls off the bench and destroys a two year old smartphone.

New price of the smartphoneEUR 800
Current value after two yearsabout EUR 400
Your deductibleEUR 150
Paid by your personal liability insuranceEUR 250

The other member receives the current value of about EUR 400, not the new price. Without a deductible your insurer pays it all, without liability insurance you pay it all yourself.

When the gym is liable

A German gym has to keep machines, floors and rooms in a condition that does not hurt members using them normally. If a worn cable on a pulley machine snaps or a loose bracket breaks after it had been loose for a while, the gym is liable. Under section 278 of the German Civil Code (BGB) it is responsible for its trainers' mistakes as if they were its own.

Signs saying you train at your own risk do not help the gym much. Under section 309 no. 7 BGB, a clause in standard terms is invalid where it excludes liability for injuries caused by negligence or for property damage caused by gross negligence.

When you are liable yourself

Anyone who negligently injures someone or damages their property must pay for it. If a weight plate slips out of your hand and hits another member, your personal liability insurance pays their medical costs, compensation for pain and suffering and lost earnings. It also fights the claim if the other person asks for too much.

Damage to the gym itself is trickier. The Federal Court of Justice classed a gym contract as a rental contract, because at its core it is about letting you use machines and rooms (judgment of 8 February 2012, XII ZR 42/10). A machine you damage while training can therefore count as a rented item, and basic tariffs exclude such damage. Normal wear and tear is never insured.

Your own accident: often nobody pays

Not every fall at the gym is the operator's fault. On 5 August 2021 the Higher Regional Court of Frankfurt (16 U 162/20) dismissed the claim of a woman who had tripped over a bright red slackline in an open training area. Anyone training there has to expect equipment and other people around them.

Your health insurance then pays for treatment. For lasting consequences, private accident insurance helps.

Theft from a locker

Providing a locker does not usually mean the gym takes your things into safekeeping. On 20 June 2005 the Higher Regional Court of Hamm (8 U 234/04) ruled for a sauna that the operator is in principle not liable for valuables taken from a locker that was broken open.

Your contents insurance (Hausratversicherung) pays through its cover outside the home (Außenversicherung) if the locked locker was broken open. That counts as burglary. If your phone was lying on a bench or the locker was not locked, it is simple theft and not insured. Cover outside the home is usually limited to part of the sum insured, often 10 percent.

When you do not need extra insurance

You do not need a special policy for the gym. A good personal liability policy already covers damage to other members, including during sport. Just check that rented items are included if you often train on expensive machines.

Leave valuables at home. The gym is rarely liable for lockers, and simple theft from the changing room is not insured.

Step by step

  1. Report the damage at the front desk right away and have it recorded in writing.
  2. Take photos of the machine or the spot and note down witnesses.
  3. Do not admit fault or pay cash before your insurer has checked the claim.
  4. Report the damage to your personal liability insurer without delay.
  5. If your locker was broken open, report it to the police and inform your contents insurer.

Checklist

  • Personal liability cover of at least EUR 10 million
  • Rented movable items included
  • Contents insurance with cover outside the home for the locker
  • Valuables not left at the gym
  • Faulty machines reported instead of used

Common mistakes

  • Relying on the liability disclaimer on the wall and not making a claim
  • Signing an admission of fault at the desk before the insurer has checked
  • Leaving your phone on the bench and hoping contents insurance will pay
  • Assuming liability insurance pays for any damage to gym equipment
