Who pays for damage to my car in a car wash in Germany?

In short

Who pays for damage to your car in a car wash in Germany? As a rule the operator. If the cause lies solely in the car wash (Waschanlage), the operator must prove it was not at fault (BGH, VII ZR 39/24). Signs such as "no liability for attached parts" do not help them for factory fitted parts. Report the damage on the spot. If the operator does not pay, your comprehensive cover can pay first.

Worked example

Estate car with factory roof spoiler, spoiler torn off in a rollover wash

The driver notices the damage at once, reports it at the till and has it confirmed on the wash receipt. An expert estimates the repair.

New spoiler, paint and fitting per expert reportEUR 2,900
Expert reportEUR 600
To be paid by the operator if it cannot clear itselfEUR 3,500
Alternatively through comprehensive cover, deductible EUR 300EUR 2,600 paid out

If the operator pays, you bear nothing yourself. Through comprehensive cover you get money faster, but first bear the deductible until the insurer recovers the money from the operator.

Why the operator usually pays

When you order a wash, you enter into a contract. The operator must wash your car so that it comes out undamaged. If brushes, blowers or the conveyor cause damage, the operator is liable if it breached its duties.

On 21.11.2024 the Federal Court of Justice (BGH) ruled (VII ZR 39/24): if the cause of the damage lies solely within the operator's area of control and risk, a breach of duty is presumed. The operator must then prove it was not at fault. In that case a rollover car wash tore off the factory fitted rear spoiler of an SUV, and the operator had to pay.

According to the ruling, if a car wash is unsuitable for a standard, commonly sold car, that is the operator's risk, not yours. The operator can exclude unsuitable models. As a customer, you cannot tell by looking at a car wash whether it suits your car.

What signs and terms achieve

Many car washes put up signs like "No liability for attached parts and rear spoilers". In the 2024 ruling exactly this wording was not enough: customers could not tell whether it also meant factory fitted spoilers. A sign that only mentions non standard parts may even suggest that standard cars are safe.

Back in 2004, the Federal Court of Justice (X ZR 133/03) struck down clauses in which an operator tried to limit its liability for exterior parts and consequential damage to gross fault. Customers may expect the operator to be liable for simple negligence too.

Your own duties in the car wash

The operator must inform you in a suitable way about the rules, for example that you must not brake while the car is pulled through the wash tunnel (BGH, 19.07.2018, VII ZR 251/17). Follow these rules, the position in a rollover wash and any instructions on aerials and mirrors.

If you ignore clear instructions, you share the blame, and compensation is reduced under § 254 of the German Civil Code (BGB). If you damage another car in the process, that is damage caused by using your vehicle and therefore a case for your motor liability insurance (Kfz-Haftpflicht).

When your car insurance helps

Under the model terms, comprehensive cover (Vollkasko) pays for an accident, meaning an event that acts on the car suddenly and directly from outside with mechanical force. Damage caused solely by operating something wrongly is expressly not included. Whether your insurer covers car wash damage is in your own policy terms.

Going through comprehensive cover makes sense if the operator refuses or things drag on. Your insurer pays minus your deductible and can recover the money from the operator. Partial cover (Teilkasko) usually does not cover such damage, except for example broken glass.

Tips if you are new to German car washes

Signs and instructions at German car washes are usually only in German. If you are unsure what to do, ask the staff before you drive in, and take a photo of the signs at the entrance.

Many car washes require you to fold in mirrors, remove or lower the aerial and keep the car in neutral in a wash tunnel. Following these steps protects your claim if something goes wrong.

When a dispute is not worth it

With a small scratch you only notice at home, proof is hard. The operator will say the damage was there before. Without photos from before and without a report on the spot, a legal dispute over a few hundred euros is rarely worth it.

It is different with a torn off part or fresh, clearly visible damage right after the wash. Then your chances are good under the case law.

Step by step

  1. Stop right after the wash and photograph the damage.
  2. Tell the staff at once and get the damage, time and wash programme confirmed in writing.
  3. Keep the wash receipt and note any witnesses.
  4. Ask the operator in writing to pay by a deadline, enclosing a cost estimate or expert report.
  5. If the operator refuses, bring in your comprehensive cover or legal expenses insurance.

Questions and answers

Frequently asked

Is the car wash liable for scratches in the paint?

Yes, if the scratch happened in the car wash and the cause lies there.

Proof is usually the hard part, so photos and a report on the spot count.

Does a "no liability for attached parts" sign apply?

Not for factory fitted parts, according to the Federal Court of Justice in 2024.

For retrofitted accessories a clear warning may have a different effect.

Does my car insurance pay for car wash damage?

Comprehensive cover can pay for accident damage, minus your deductible.

Liability insurance only pays if you damage another car.

Will my comprehensive no claims class be downgraded?

If your insurer recovers the full amount from the operator,

the policy counts as claim free under the model terms.

Otherwise it is downgraded.

What about a self service wash bay?

There you handle the lance yourself.

You usually bear damage from wrong use, but a defect in the equipment can make the operator liable.

How quickly do I have to report the damage?

As soon as possible, ideally before you drive off.

The later you report it, the harder it is to prove the damage came from the car wash.
