Representative

Boat insurance term, area: Owner duties

In insurance law a representative is not every guest at the wheel. The word describes someone who, with the owner's knowledge, takes charge of the boat as though it were their own: the friend who looks after her through the winter, the manager of a charter fleet, the partner who keeps her for a whole season. What that person neglects counts as the owner's own neglect, which is why one seacock left open after launching can decide a claim. Standing a watch or helping out for an afternoon does not make anybody a representative.

What to check: Two questions for your own contract: whose conduct is attributed to you, only that of a representative, or that of anyone you let use the boat? And what follows from such a person breaching a duty, a payout reduced in proportion to the fault, or no payout at all?
