Does legal expenses insurance pay for a traffic fine notice in Germany?

In short

Does legal expenses insurance pay for a traffic fine notice (Bußgeldbescheid) in Germany? Yes, if you have the traffic module. It pays your lawyer, the court, an expert and the authority's costs. You always pay the fine yourself. Under the model terms there is no waiting period. With a driving ban the policy almost always pays off, for a parking offence usually not.

Does legal expenses insurance pay for a traffic fine notice in Germany?

What it costs

Official amounts from the fine catalogue, the Administrative Offences Act, the Lawyers' Remuneration Act and the Court Fees Act.

ExampleTypical range
Warning fine, no noticeEUR 5 to 55, no fees
Fee and delivery of a fine notice5 percent of the fine, at least EUR 25, plus EUR 3.50
Lawyer for a fine of EUR 80 to 5,000, basic feeEUR 36 to 204 net
Lawyer, procedural fee at the authority and at courtEUR 36 to 348 net each
Lawyer, hearing fee per day of hearingEUR 48 to 564 net
Court costs if you lose at the local court10 percent of the fine, at least EUR 60

As of November 2026.

Standard fines under the fine catalogue regulation as amended on 12.08.2026,

points under the Road Traffic Act and the Driving Licence Regulation.

What the policy pays follows the GDV model terms ARB 2021, as of June 2025; your tariff may differ.

The EUR 150 deductible in the example is a guide value from our quoting practice.

Worked example

34 km/h over the limit in town, objection up to court

A commuter is measured at 34 km/h over the limit in town. The notice states EUR 260, a one month driving ban and two points. His lawyer checks the measurement, there is a hearing, and the court confirms the notice. Calculated with the middle of the statutory fee ranges.

Lawyer at the authority: basic fee, procedural fee, expensesEUR 332 net
Lawyer at court: procedural fee, hearing, expensesEUR 518 net
Lawyer in total with 19 percent VATEUR 1,011.50
Court costs, 10 percent of EUR 260, minimumEUR 60
Fee and delivery of the noticeEUR 28.50
FineEUR 260

Without a policy he pays around EUR 1,360. With traffic legal cover and a EUR 150 deductible, EUR 410 is left: the fine and the deductible. Had the check of the measurement overturned the driving ban, the difference would be even greater.

What the policy pays and what not

For a traffic fine notice, the relevant part of legal expenses insurance (Rechtsschutzversicherung) is cover for administrative offences (Ordnungswidrigkeiten-Rechtsschutz). It is part of the traffic module (Verkehrsrechtsschutz), and for the self employed also of the business policy. Under the model terms of the German insurance association (GDV), the insurer pays for your defence if you are accused of an administrative offence.

The insurer pays your lawyer at the statutory fees, the court costs, the procedural costs the authority charges you and, in traffic matters, a technically qualified expert, for example to check the speed measurement. The fine itself is not one of the costs legal expenses insurance covers. Nor can it take a driving ban off your hands; it only pays for the attempt to avoid it.

No waiting period and no check of prospects

Two rules make a fine case easier for policyholders. First, under the model terms there is no waiting period for administrative offences. If you take out cover today, you are protected for an offence from tomorrow. That does not apply to an offence that happened before the policy started.

Second, in fine proceedings the insurer may not refuse on the grounds that your defence has no prospect of success. The model terms only provide for this check in civil law areas. Unlike criminal law, the model terms for administrative offences also have no exception for intent. Your tariff may differ, so read the policy terms before you sign.

What the official fine catalogue sets for 2026

Standard fines are set in the German fine catalogue regulation (Bußgeldkatalog-Verordnung), last amended in August 2026. Up to EUR 55 it is a warning fine (Verwarnungsgeld). That has no fees and no points, and a defence is practically never worth it. From EUR 60 you get a fine notice with at least EUR 25 in fees and EUR 3.50 for delivery, and an offence that carries points is entered in the central driving register in Flensburg (Fahreignungsregister).

From here it gets serious. With eight points your licence is gone. The offences with a driving ban in the table count two points, the others one. The table shows typical standard rates for cars.

What a defence costs

In fine proceedings, lawyers charge within fixed fee ranges. For a fine of EUR 80 to 5,000, the basic fee is EUR 36 to 204, the procedural fee at the authority and at court each EUR 36 to 348, and the hearing fee EUR 48 to 564. On top come up to EUR 20 in expenses per stage and VAT.

If you lose at the local court (Amtsgericht), the proceedings cost 10 percent of the fine, at least EUR 60. With a driving ban or a second point, you quickly reach over EUR 1,000 including court. With a warning fine of EUR 30, on the other hand, any lawyer costs more than the offence.

If you drive in Germany with a foreign licence

Fine notices and the register in Flensburg apply to you as a resident driver in Germany, whatever country issued your licence. A driving ban means you may not drive in Germany for that period.

Fine notices are written in formal German, and the two week deadline runs from delivery, not from when you understood the letter. If you have trouble with the language, send a copy to your insurer or a lawyer straight away.

When you do not need a policy

If you rarely drive and have never had a fine notice, the traffic module mainly buys you peace of mind. If you only want cover for parking offences, do not take it out: the model terms provide an exclusion for them, and the amounts are not worth a defence.

Cover makes sense if your job depends on your licence, you already have points or you drive a lot. Then a single notice decides on a driving ban, which costs more than any annual premium.

Step by step

  1. Note the date of delivery, the two weeks to object run from then.
  2. Check whether it is a warning fine up to EUR 55 or a fine with points or a driving ban.
  3. Report the case to your legal expenses insurer with a copy of the notice.
  4. Instruct a lawyer who inspects the file and checks the measurement.
  5. Wait for confirmation of cover before an expert is appointed.
  6. Only pay the fine once it is clear you will not object.

Checklist

  • Traffic module with cover for administrative offences in the policy
  • Stopping and parking offences: excluded or included, checked in the terms
  • Technical expert for measurements covered
  • Deductible per case known
  • Cover also as driver of other vehicles, for example a company car
  • Deadline to object in your calendar

Common mistakes

  • Letting the two week deadline pass, after which the notice is final
  • Paying the fine at once and so practically giving up the objection
  • Taking out the traffic module only after the speed camera, the earlier offence is not covered
  • Hiring a lawyer for a EUR 30 warning fine and losing the deductible

Questions and answers

Frequently asked

Is there a waiting period for traffic fines?

Not under the model terms.

But the offence must have happened after the policy started.

Can the insurer refuse because an objection has no chance?

Not under the model terms.

The check of prospects there only applies to civil disputes, not to administrative offences.

Is a parking offence covered?

Often not.

The model terms provide an exclusion for stopping and parking offences, which many insurers adopt.

A defence is rarely worth it there anyway.

How long do I have to object?

Two weeks after delivery of the fine notice, in writing or on record at the authority.

When do I get points?

An offence that carries points is registered from a EUR 60 fine or with a driving ban.

Serious offences like those with a driving ban in the table above count two points,

lighter ones one.

Does the policy also pay for a company car?

Yes, if you are covered as driver of other vehicles,

which the traffic module provides for in the model terms.
