Co-ownership form

Co-ownership: who runs the contract

Two A4 pages for the boat with several owners. Page 1 takes the vessel, the contract, the owners with their shares and the power of attorney of the authorised owner, page 2 settles who receives payment, the bank details, the deductible and the costs, and carries the signatures. Fill it in before the contract starts, not after the first claim.

Only the sheet itself is printed, without the navigation and the footer. A working aid without legal force and no legal advice. This is a translation of a form drawn up under German law; in a dispute the German version governs. For the internal arrangements between the owners a separate agreement is advisable as well.

All owners are policyholders. The shares govern how a settlement is divided, not the cover, which follows the vessel.

03Power of attorney

The owners named above authorise the following person to act for the co-ownership towards NAMMERT and the insurer. The power of attorney is valid until it is revoked in writing by one of the owners.

The claim is not the problem, the question that follows it is: who decides on the repair, who gets the money, who carries the deductible? Without a power of attorney settled in advance every declaration needs the consent of all, and for as long as that is missing the settlement stands still. So put down as well from what amount everybody has to decide together and how the deductible is split.

Worth knowing

We insure a boat held in co-ownership exactly as a boat in single ownership: the cover follows the vessel, and everybody entitled to operate her with the prescribed licence is insured. Tell us about every change of owner: whoever is not named in the contract has no claim either if it comes to a dispute. When a share is sold the policyholder changes, not the risk, which is why the change costs nothing.
