How much does business legal expenses insurance cost for small firms in Germany?
In short
How much does it cost? In Germany, business legal expenses insurance (Firmenrechtsschutz) for small firms usually costs between EUR 100 and 1,300 a year. A sole trader in a low risk job pays from about EUR 100, a plumbing firm with five staff about EUR 490 to 1,304 for the same cover. Headcount, trade, deductible and contract cover drive the price.

Worked example
Plumbing firm with five staff, one unfair dismissal claim
A plumber earning EUR 3,000 a month challenges his dismissal. The case settles at first instance.
Annual premium, same cover
about EUR 490 to 1,304
Value in dispute (three monthly salaries)
EUR 9,000
Own lawyer with settlement, incl. VAT
about EUR 2,490
Costs refunded by the other side at first instance
none
With business legal cover and EUR 250 deductible
you pay EUR 250
One labour dispute costs as much as two to five years of premium. This only works if the dismissal happens after the waiting period has ended.
What drives the premium for business legal expenses cover
German business legal expenses insurance is built from modules (Bausteine), each with its own price. The basic form with damages, criminal and tax court cover is cheap for small firms. Employer cover, contract cover (Vertragsrechtsschutz) and company vehicles make it more expensive.
Employer cover is usually priced by headcount, contract cover often by turnover. A deductible of EUR 250 or 500 per case lowers the premium noticeably.

Company vehicles

Why the same cover can cost twice as much for a small firm
A published comparison for a plumbing business with five employees shows the range: with similar modules and unlimited cover, annual premiums ran from about EUR 490 to 1,304. Most of the gap came from the deductible and from whether contract cover was included.
Policies without a deductible are almost always much dearer. For small firms that rarely end up in court, a EUR 250 deductible is often the better deal on business legal expenses insurance.
What a single labour court case costs a small employer
At the German labour court (Arbeitsgericht) each side pays its own lawyer at first instance, even the winner (§ 12a Labour Courts Act). If an employee earning EUR 3,000 a month challenges a dismissal, the value in dispute is capped at three monthly salaries, so EUR 9,000 (§ 42 (2) Court Fees Act).
Your own lawyer then costs about EUR 1,790 under the statutory fee scale, or about EUR 2,490 if the case ends in a settlement. For a small firm that is more than a year of legal expenses premium.
Contract cover: expensive, but often what small firms really need
Disputes with customers about invoices and defects are not part of standard German business legal expenses cover. Some insurers sell contract cover separately, usually with a cap on the value in dispute, a higher deductible and a longer waiting period.
For simply collecting undisputed invoices, the German court dunning procedure (Mahnverfahren) is often enough and much cheaper. Contract cover pays off when customers regularly dispute the work itself.
When a small firm needs little or no business legal cover
If you work alone, take payment upfront, rent no premises and employ nobody, your risk of legal disputes is low. The basic form is then often enough, and expensive contract cover can wait.
As soon as you employ someone, even on a minijob, employer cover usually pays off because of the labour court cost rule.
Who arranges the cover and what it costs you
Norman Nammert arranges business legal expenses insurance as an insurance broker (Versicherungsmakler) and compares offers with the same cover. The insurer pays the broker's commission, so the service is free for you.
Step by step
Write down the three disputes your business is most likely to face.
Have headcount, turnover, vehicles and rented premises ready.
Choose modules: basic form, then employer, contract, property, traffic.
Pick a deductible; EUR 250 is a sensible middle ground.
Compare quotes with identical cover, not just the price.
Get the waiting period and credit for any previous policy confirmed in writing.
