When do you count as a non-smoker for term life insurance?

In short

Usually when you have not smoked or inhaled nicotine for at least 12 months. Vaping almost always counts as smoking, and so does the odd cigarette at parties. The difference is expensive: smokers pay roughly two to three times as much. Some German policies give an even lower rate if you have been smoke free for ten years.

Quitting a year before you apply, or switching after a smoke free year, saves around 12,000 euros over the term. A false answer puts the whole 300,000 euros at risk.

What most insurers mean by non-smoker

The common rule: in the past 12 months you have not smoked cigarettes, cigars, cigarillos or a pipe, and have not inhaled nicotine from an e-cigarette or vaporiser. The key word is active. Passive smoking does not count.

The exact wording sits in the application questions and the policy terms, and it varies. Some insurers ask about tobacco, others about nicotine in any form. Under the second wording, patches, gum, snus or heated tobacco can also make you a smoker.

What the difference costs

A 30 year old paying for 100,000 euros over 20 years pays around 4 to 5 euros a month as a non-smoker and around 10 euros as a smoker. At 45 with 300,000 euros the gap grows: around 31 to 44 euros against around 94 euros.

The reason is simple: smokers statistically die earlier, mainly from heart disease and cancer. The older you are, the more this weighs on the premium.

Why honesty pays here

If you state you are a non-smoker but smoke, you breach your duty of disclosure. After a death, the insurer checks carefully, often with medical records. If they mention smoking, the insurer can withdraw from the contract or contest it for fraudulent misrepresentation. Your family then receives nothing.

In cases of intent or fraud, German law lets the insurer rely on this for up to ten years after the start. A few euros saved each month stand against the whole sum insured.

Quitting and switching

Once you are 12 months smoke free, many insurers let you apply to move to the non-smoker rate. You sign a new declaration, sometimes a test is required. You only have a right to this if your contract provides for it.

If your insurer does not offer it, a new policy can be cheaper even at an older entry age. Only cancel the old one once the new one has been accepted.

When the smoker rate is fine

If you smoke and do not want to stop, still take out cover when family or a loan depends on your income. The smoker rate is high, but an honest contract pays. A false non-smoker policy is worthless when it matters.

Smokers can save elsewhere: with a decreasing sum for a loan, a term that fits and a sum no higher than needed.

  2. Read the smoking question carefully: does it ask about tobacco or nicotine?
  3. If your last use was just under 12 months ago, wait or switch rates later.
  4. With policies that have a ten year tier, check whether you can show the longer period.
  5. After 12 smoke free months, ask to move to the non-smoker rate in your current policy.
