Who is liable in an accident with a rental e-scooter in Germany?
In short
Who is liable in an accident with a rental e-scooter in Germany? Damage to others is paid by the operator's motor liability insurance, which covers you as the rider. It does not pay for your own injuries or damage to the scooter. Ride drunk and the insurer can claim up to EUR 5,000 back from you. For the scooter itself you are liable under the rental terms.

Who pays in an accident with a rental e-scooter
Legally an e-scooter is a motor vehicle. The operator is the keeper and must have motor liability insurance (Kfz-Haftpflicht). It pays if you injure a pedestrian or damage a car with a rental e-scooter, and you as the rider are covered.
The keeper is liable even without fault. The exception for slow vehicles up to 20 km/h in Section 8 of the Road Traffic Act (StVG) expressly does not apply to e-scooters under the e-scooter regulation.

When you pay yourself
Liability insurance does not pay for your own injuries. If you fall alone, health insurance pays treatment; compensation for lasting harm only comes from private accident insurance. On the way to work, statutory accident insurance may apply.
For damage to the scooter you are liable to the operator under its terms. Many operators charge up to a cap for damage or loss, and some sell a reduction for a fee.
Drink riding and other breaches
E-scooters have the same alcohol limits as cars. If you ride drunk and cause an accident, the insurer still pays the victim. Afterwards it may reclaim up to EUR 5,000 from you.
The same applies after drugs or without the required entitlement. Your own personal liability insurance does not step in here, as it usually excludes motor vehicles that require insurance.
Which insurance is worth it for frequent riders
If you often ride rental e-scooters, check private accident insurance first. It pays for lasting harm after a fall, whoever is at fault.
You do not need your own scooter liability insurance for rentals. If you ride occasionally and already have accident cover, you need nothing more.
