Who needs business liability insurance in Germany?

In short

Almost anyone who runs a business or works freelance in Germany and deals with customers, their premises or their property. It is required by law only in a few trades, such as security services. Clients, landlords and tenders often demand proof, though. For pure desk work, professional indemnity may be enough, but personal liability insurance does not cover business damage.

Side business: baking cakes for events

An employee bakes cakes at weekends and sells them for birthdays and weddings. A guest has an allergic reaction because an ingredient was not declared.

With business liability the insurer examines and pays the claim. Without it the baker bears the loss personally, which quickly reaches five figures when someone is injured.

Why you are liable as a business owner

Under German law, anyone who negligently causes damage to someone else must pay for it. That applies at work just as in private life, only the amounts tend to be higher: a customer trips over a cable in your shop, an employee scratches a client's parquet floor, a guest falls ill after a meal.

As the owner you are also responsible for mistakes made by your staff. Without insurance the business pays, and as a sole trader (Einzelunternehmer) you pay with your private assets too. The insurer pays justified claims and fights unjustified ones, in court if necessary.

Who needs it and who probably does not

It is essential in the trades, in retail with a shop, in hospitality, for services with customer contact and wherever you work on other people's premises.

It is less urgent if you only work at your own desk, never receive clients and never handle other people's property. Then the bigger risk is financial loss caused by a professional mistake, which is covered by professional indemnity (Vermögensschadenhaftpflicht). Many freelancer tariffs combine both at a low price.

When it is mandatory

Germany has no general insurance obligation for businesses. If you register a security business, however, you must show the authority liability insurance with fixed minimum limits set out in the security services regulation (Bewachungsverordnung). For some chamber professions, the professional rules require professional liability cover.

More often the obligation comes from contracts. Large clients, landlords of commercial space, market organisers and public tenders ask for an insurance certificate (Versicherungsbestätigung) before you may start.

Why your personal liability policy is not enough

Personal liability insurance (Privathaftpflicht) covers everyday private life. Business and freelance activities are excluded as a rule. That includes small side businesses, such as selling homemade jewellery online or paid dog walking.

Some tariffs include minor side activities up to a turnover limit. Whether yours qualifies is written in your policy terms. Do not rely on it without reading them.

  1. Write down where and how you work: at customers' homes, in your own shop or only at your desk.
  2. Check whether your trade or a client requires proof of insurance.
  3. Read your personal liability terms to see whether side activities are excluded.
  4. Work out whether you mainly risk injury and property damage or financial loss.
  5. Take out cover before your first job, not after your first claim.

Do I need it before registering my business?

It should apply from your first job at the latest. Many insurers offer simple tariffs for start-ups.

Does it cover my own tools?

No, it only pays for damage you cause to others. Your own equipment needs contents insurance for businesses (Inhaltsversicherung).
