04Liability if something happens
The prospective buyer confirms holding the licence required for this boat and undertakes to handle her carefully. If damage occurs during the sea trial that the owner's hull insurance meets, the prospective buyer reimburses the owner the agreed deductible together with the disadvantage arising from the loss of the no-claims discount.

Where the prospective buyer acts with intent or gross negligence, any further claims of the owner remain unaffected. Damage to third parties is met by the owner's boat liability cover; it attaches to the vessel and covers every authorised helmsman holding the licence required.

A note for sellers
Make sure the prospective buyer really does hold the licence required, and put the agreement in writing: if there is damage during the sea trial, the prospective buyer can reimburse you the deductible and the loss of the no-claims discount on the owner’s hull insurance. Gross negligence is included at NAMMERT: Basis Plus up to 25 %, Premium up to 50 % of the sum insured.
