Boating ban: when do you lose your licence, and is there a way round it?
Skippers caught over the alcohol limit or repeatedly breaking the rules can lose their boating licence. The first part explains the rules in Germany. Below, the world map shows for each country when a ban applies, how long it lasts and what you may still drive, each with an official source.
When does a boating ban apply in Germany?
On federal waterways the limit is 0.5 per mille, or 0.25 mg/l in the breath. Anyone who skippers above it pays a fine of 350 to 2,500 euros, at sea 750 to 2,500 euros. From 1.1 per mille it is a criminal offence, after an accident or with clear signs of impairment from 0.3 per mille. On Lake Constance the limit is 0.8 per mille.[9][10][17][18][20][12][21]
You lose the German recreational boating licence if you are unfit or unreliable. Unreliable above all means a conviction for a serious traffic offence. Even a fine for repeated boating under alcohol or drugs, or for repeated speeding, usually leads to a suspension. The water police can take the licence on the spot.[1][2][3][4]
The federal waterways authority (Generaldirektion Wasserstraßen und Schifffahrt) decides on withdrawal and suspension. The regulation sets no fixed periods. Driving while suspended risks a fine of 300 to 1,500 euros. From January 2017 to September 2018, 22 licences were withdrawn on maritime waterways, 15 of them for alcohol.[2][6][7][19][24]
Can you get round it?
Not with a small boat: while a suspension runs, you may not skipper any recreational boat, including licence-free motorboats up to 15 hp. Rowing and paddling boats and sailing boats with no more than 6 m² of sail remain allowed. After a withdrawal the regulation contains no such ban. The alcohol limits apply on every vessel.[2][5][8][1][9]
What about your driving licence?
A German criminal court only withdraws a driving licence for offences committed with a motor vehicle. A driving ban of one to six months is possible for any criminal offence, though. The police report signs of unfitness to the driving licence office, which can order a medical and psychological assessment (MPU) if alcohol abuse is suspected.[13][14][16][15]

Suspension in law
- When
- The Generaldirektion Wasserstraßen und Schifffahrt (federal waterways and shipping authority) withdraws the recreational boat licence (Sportbootführerschein) if someone is unfit or unreliable. Unreliable above all means someone with a final conviction for a serious traffic offence, for example drunkenness or endangering shipping traffic. Even where there are doubts, it can order the licence to be suspended (Ruhen), as a rule after a fine for repeatedly boating at 0.5 per mille or more or under drugs, or for repeated speeding. If there is strong suspicion, the Wasserschutzpolizei (water police) can seize the licence at once; until a decision is made, this has the same effect as a suspension.
- Alcohol limit
- Federal waterways (inland, Rhine and sea): boating ban from 0.5 per mille in the blood or 0.25 mg/l breath alcohol; at sea this also applies to personal watercraft, kiteboards and surfboards. Fine 350 to 2,500 euros (inland) or 750 to 2,500 euros (sea). THC from 3.5 ng/ml. From 1.1 per mille, absolute unfitness to operate and a criminal offence under § 316 StGB; in case of an accident, signs of impairment or grossly reckless operation, criminal proceedings already from 0.3 per mille (figure from the Brandenburg police). On the Oder, an administrative offence already from 0.2 per mille (Brandenburg police). Lake Constance: 0.8 per mille or 0.40 mg/l, for passenger and cargo vessels 0.1 per mille.
- How long
- The Sportbootführerscheinverordnung (recreational boat licence regulation) sets no fixed periods and no waiting period (Sperrfrist). The suspension is ordered for a fixed or an indefinite period; the period runs from when the licence is handed in. An indefinite suspension is only lifted once fitness and reliability are restored. Withdrawal ends the licence; a new licence can be issued and may come with conditions.
- What stays allowed
- Boats up to 11.03 kW (15 hp) with a combustion engine or 7.5 kW with an electric motor need no licence. During an ordered suspension, however, the regulation bans operating any recreational boat; by its definition this also includes licence-free motorboats and personal watercraft, but not human-powered boats or boats with no more than 6 m² of sail. After a withdrawal, the regulation contains no express ban on licence-free boats. The alcohol limits apply on every craft.
- Driving licence
- The criminal court withdraws a car driving licence under § 69 StGB only for offences committed while driving a motor vehicle. Under § 44 StGB, however, it can impose a driving ban for motor vehicles of one to six months for any criminal offence, even with no link to a car. The Fahrerlaubnisbehörde (driving licence authority) orders a medical and psychological assessment (MPU) if facts point to alcohol abuse (§ 13 sentence 1 no. 2 a FeV); the case groups 1.6 per mille and repeated drink-driving (no. 2 b and c) apply only to road traffic. The police must report to the driving licence authority any facts that suggest a lasting lack of fitness (§ 2 para. 12 StVG).
- Foreign skippers
- Anyone who lives abroad and is in Germany for no more than one year needs no German licence if their home country does not require one; if it does, the home licence or the ICC is valid. For a foreign licence, withdrawal means it may no longer be used in Germany. The Wasserschutzpolizei (water police) may also provisionally seize another certificate of competence. The alcohol limits apply to everyone who operates a craft.
- Who decides
- Generaldirektion Wasserstraßen und Schifffahrt (federal waterways and shipping authority; withdrawal, suspension, fines under the SpFV); Wasserschutzpolizei (water police; seizure, banning further travel); criminal court (§§ 315a, 316 StGB); Fahrerlaubnisbehörde (driving licence authority; car licence). Lake Constance: Landratsamt Lindau (district office, Bavaria), Landratsämter Bodenseekreis and Konstanz (district offices, Baden-Württemberg).

Australia
Partly regulated
- When
- Boating law is a matter for the states. In NSW, alcohol or drug offences, dangerous operation, repeated offences or lack of fitness can lead to suspension, withdrawal or disqualification from the boat licence; for alcohol and drug offences, disqualification is automatic. In Western Australia, you can be disqualified from the Recreational Skipper's Ticket if you are over the limit or have drugs in your body; a provisional boating ban is also possible. In Victoria, the boat licence can be withdrawn for serious safety offences.
- Alcohol limit
- NSW: recreational boats under 0.05, under 18 years 0.00; levels 0.05 to 0.08, 0.08 to 0.15 and from 0.15. Victoria: from age 21 under 0.05, under 21 0.00, also at anchor. Western Australia: 0.05, higher penalties from 0.08 and 0.15.
- How long
- NSW: automatic disqualification of 3 to 12 months, with a prior offence within five years 6 months to 2 years; the court may also set shorter periods. Western Australia: above 0.08 for a first offence 750 to 2,250 AUD and 6 months disqualification; above 0.05 an infringement notice of 1,000 AUD or a penalty of up to 1,250 AUD.
- What stays allowed
- Western Australia: the alcohol rules apply to all recreational boats including sailing boats, dinghies and tenders, even without a licence requirement; paddle craft, windsurfers and kiteboards are not meant to be tested.
- Driving licence
- Western Australia: there are currently no plans for an alcohol or drug offence on the water to lead to a ban on the car driving licence. Victoria: points and bans in road traffic do not affect the boat licence.
- Who decides
- NSW: court, Transport for NSW, police. Victoria: court, Safe Transport Victoria. Western Australia: Department of Transport, police, court.
- Legal basis
- NSW: Marine Safety Act 1998 ss. 20 to 28C, in particular s. 22, s. 24, s. 28A. Victoria: Marine (Drug, Alcohol and Pollution Control) Act 1988; Marine Safety Act 2010. Western Australia: Western Australian Marine Act 1982; Western Australian Marine (Alcohol and Drug Testing) Regulations 2024.[91][92][93][94][95][96][97]

Suspension in law
- When
- Anyone who operates a recreational boat with 0.8 per mille or 0.4 mg/l breath alcohol or more must have their certificate of competence (Schiffsführerpatent) suspended; the same applies if they refuse the breath test. Even someone who is obviously impaired by alcohol, drugs, agitation or fatigue loses it for a time. It is withdrawn if requirements are no longer met, for repeated serious offences, after a failed re-examination or if a medical report is missing. If the car driving licence is withdrawn because of alcohol, the boat licence is also suspended.
- Alcohol limit
- From 0.5 per mille or 0.25 mg/l, every boat operator counts as impaired and may not operate (administrative offence, 72 to 3,633 euros). For recreational boats, the licence is suspended from 0.8 per mille or 0.4 mg/l. Commercial shipping: 0.1 per mille or 0.05 mg/l. Lake Constance: 0.8 per mille or 0.40 mg/l (passenger and cargo vessels 0.1 per mille), penalty there up to 2,180 euros.
- How long
- Suspension six months; for the first repeat within five years one year, for the second two years. If the car driving licence is withdrawn (alcohol or addictive substances), for the duration of that withdrawal. A seizure by the shipping police counts as a suspension until a decision is made; for mere fatigue or agitation, the licence is returned if the condition is over within two days.
- What stays allowed
- During the suspension, the ban covers only craft for which a certificate of competence is required. Motorboats for sport and leisure under 4.4 kW do not need one. The 0.5 per mille limit, however, applies to every boat operator. An appeal against the withdrawal decision has no suspensive effect.
- Driving licence
- Only the reverse direction is documented: if the motor vehicle driving licence is withdrawn by final decision because of alcohol or addictive substances, the boat licence is suspended for the same period (§ 125 para. 3 SchFG).
- Foreign skippers
- Foreign operators of sport craft need no Austrian licence if they hold a matching home licence or an ICC. A foreign certificate can be seized and is sent to the competent Austrian authority. For repeated serious offences, the right to boat on Austrian waters is revoked; the certificate is sent to the issuing authority.
- Who decides
- The Schifffahrtspolizei (shipping police; officers under § 38 para. 2 SchFG) seizes the licence and prevents further travel. The issuing authority decides on suspension and withdrawal: the Bundesministerium für Innovation, Mobilität und Infrastruktur (federal ministry for innovation, mobility and infrastructure; Schiffsführerpatent AT) or the Landeshauptmann (state governor) of Upper Austria, Lower Austria or Vienna (licence 10 m and 20 m). Penalties: Bezirksverwaltungsbehörde (district administrative authority); Lake Constance: the district administrative authority responsible for Lake Constance.
- Legal basis
- SchFG §§ 1 para. 4, 5 para. 2, 6 para. 1 and 6, 42 para. 1 and 2 Z 2, 2a, 3, 117 para. 1, 119 para. 1 Z 3 and 6, 124, 125, 126, 141, 154; SFVO §§ 3 Z 11, 4 para. 6; Bodensee-Schiffahrts-Ordnung §§ 6.01 para. 3, 12.01, 12.08; BG BGBl. Nr. 65/1976 Art. I and II.[27][28][29][30]

Suspension in law
- When
- At sea: for alcohol from 0.22 mg/l breath or 0.5 g/l blood, for drugs above the limits, for refusing a breath or blood test, and for boating without the required licence or despite a ban (Art. 4.1.2.8/3 §§ 2, 3). In addition to the penalty, the right to operate can be withdrawn (§ 5). After a conviction, also for physical or mental unfitness (§ 6).
- Alcohol limit
- 0.22 to under 0.35 mg/l breath or 0.5 to under 0.8 g/l blood: sanction level 2. From 0.35 mg/l or 0.8 g/l: sanction level 3. Drugs: fixed limits in saliva and blood, e.g. THC 1 ng/ml blood.
- How long
- Withdrawal of the right to operate 1 month to 5 years or for life (§ 5). During this time the licence must be handed in to the shipping police. A medical certificate can be required. For unfitness: until fitness is proven (§ 6). Enforcement officers can hold the licence or certificate of competence at once; the King sets the duration (§ 4).
- What stays allowed
- According to the FPS Mobility and Transport (FÖD Mobilität), a boat licence is needed for motorboats faster than 20 km/h, boats over 15 m hull length and commercial use.
- Foreign skippers
- The rule applies to all vessels in Belgian maritime areas and to vessels entering and leaving, so also to foreign boats (Art. 4.1.2.8/3 § 1).
- Who decides
- Enforcement officers appointed by the King (holding the licence). The withdrawal follows the procedure of the law of 25.12.2016 on administrative fines in shipping (Art. 4.1.1.8).
- Legal basis

Suspension in law
- When
- It is a criminal offence to operate a boat if alcohol or drugs impair your ability. It is also an offence to be over the limit within two hours after operating. The Criminal Code expressly counts vessels as conveyances. After a conviction, the court must impose an operating prohibition.
- Alcohol limit
- 80 mg of alcohol per 100 ml of blood (0.8 ‰) within two hours after operating. Any impairment by alcohol or drugs is also an offence. Drugs have their own limits.
- How long
- Mandatory prohibition: for a first offence 1 to 3 years, for a second 2 to 10 years, after that at least 3 years each time. Time in prison is added in each case. For more serious offences, for example with injuries or deaths, up to 10 years or with no limit.
- What stays allowed
- The prohibition applies to the type of conveyance used for the offence. A prohibition for a car offence applies only on roads and public places. Boats without an engine need no proof of competency. The Pleasure Craft Operator Card is valid for life.
- Driving licence
- Transport Canada: even on a first conviction for boating under alcohol, you face 'boating and driving prohibitions' and seizure of the boat or car.
- Foreign skippers
- The Criminal Code applies to everyone in Canada. Foreigners with their own boat registered abroad need no Canadian proof of competency for up to 44 days in a row. An equivalent licence from their state or country is also recognised.
- Who decides
- Criminal court (prohibition), Transport Canada (proof of competency), police.
- Legal basis
- Criminal Code s. 320.11 (conveyance includes vessel), s. 320.14(1), s. 320.24(1) to (5), (8), (10); Competency of Operators of Pleasure Craft Regulations.[85][86][87][88][89]

- What stays allowed
- The alcohol offence under Art. 1006 is not on the list in Art. 1007; for it, the text provides only a fine.
- Foreign skippers
- Art. 134 names operators of a ship, yacht or boat with no restriction by flag. The text does not say whether a foreign licence is held.
- Who decides
- Maritime safety inspector of the harbour master's office (lučka kapetanija) or another authorised person; the harbour master's office decides on maritime offences at first instance.
- Legal basis
- Pomorski zakonik Art. 134 (alcohol, test, removal up to 8 days), Art. 1006 (fine for alcohol and test refusal), Art. 1007 (protective measure, withdrawal 1 month to 2 years).[47][48]

Separately, it is an offence to be unfit to operate due to alcohol or other intoxicants (para. 4).
- How long
- Unconditional withdrawal 6 months to 5 years or forever (§ 29 e para. 3). Conditional withdrawal with a 3-year probation period is possible (para. 5). For a withdrawal of more than 3 years, you can ask the court for reinstatement at the earliest 3 years after the judgment, and only in very special circumstances (para. 4). The police can withdraw the right provisionally; this time is counted (para. 6).
- What stays allowed
- The fixed 0.50 ‰ limit does not apply to recreational boats with no training requirement (except personal watercraft). A speedboat licence (speedbådsbevis) is mandatory for certain planing recreational boats under 15 m, depending on length and engine power. Rowing boats: drink-boating only with a fine (§ 29 c para. 2). Anyone who boats despite a withdrawal pays a fine, for a repeat up to 1 year 6 months in prison (§ 29 d).

Italy
Suspension in law
- When
- Above 0.5 g/l blood alcohol, the patente nautica is always suspended, graded by level. The same applies for drugs and for refusing the test. Speeding in ports and near beaches, and keeping too little distance from divers, also lead to suspension. A repeat within two years leads to revocation.
- Alcohol limit
- Above 0.5 to 0.8 g/l, above 0.8 to 1.5 g/l, above 1.5 g/l. Under 21 and for commercial use, even above 0 to 0.5 g/l is banned.
- How long
- 0.5 to 0.8 g/l: 3 to 6 months. 0.8 to 1.5 g/l: 6 months to 1 year. Above 1.5 g/l or refusing the test: 1 to 2 years, and the boat is seized. Drugs: 1 to 2 years. Revocation for a repeat within 2 years and for an accident with above 1.5 g/l. Speeding and diver offences: 1 to 3 months. Along with the suspension, a medical examination within 60 days is ordered. On the spot, the licence can be held for up to 10 days.
- What stays allowed
- The fines apply to every recreational boat, even without a licence requirement. Allowed without a licence are boats up to 24 m within 6 nautical miles if the engine stays below the limits of Art. 39 (among others no more than 30 kW or 40.8 hp); not jet skis. Anyone who boats where a licence is required despite suspension or revocation pays 2,755 to 11,017 euros.
- Foreign skippers
- The bans apply to anyone who operates a recreational boat (chiunque). The text does not say whether a foreign licence is held.
- Who decides
- Enforcement officers for the test and for holding the licence for up to 10 days; the authority that issued the licence orders the suspension and the medical examination.
- Legal basis
- D.Lgs. 171/2005 (Codice della nautica da diporto) Art. 53-bis (alcohol), Art. 53-ter (under 21, commercial), Art. 53-quater (drugs), Art. 53 para. 1, 9, 10 (boating without or despite suspension, suspension 1 to 3 months, revocation), Art. 39 (licence requirement).[40][41][42][43][44]

Japan
Suspension in law
- When
- Anyone who operates a small boat although they cannot steer normally because of alcohol, drugs or other reasons breaches the duties of a boat operator. Such breaches bring points. If the type and number of breaches reach the set threshold, the transport ministry can suspend the boat licence or issue a warning. For other breaches of the law, withdrawal is also possible.
- Alcohol limit
- The law sets no figure. Operating is banned if normal steering is not possible because of alcohol or drugs.
- How long
- For breaches of the boat operator's duties: suspension up to 6 months or a warning. For other breaches of the law: withdrawal or suspension up to 2 years. The basis is the points of the last year and the measures of the last three years. After a measure ends, the points go back to zero.
- What stays allowed
- Anyone who attends a retraining course gets 2 points deducted. The measure can then be dropped entirely or be milder. As a rule, the retraining must be attended within one month of the decision.
- Who decides

Malta
Suspension in law
- When
- Transport Malta can suspend, cancel or revoke any licence under the Small Ships Regulations at any time without giving reasons. Anyone convicted of an offence under these rules, for example operating a small boat under the influence of alcohol, as a rule loses the right to any licence from the authority for 12 months.
- How long
- Court ban of 12 months from conviction, unless the court decides otherwise for special reasons; a longer ban is possible. After a repeat conviction, the court can cancel the licence. A suspended or revoked licence must be handed in within 24 hours.
- What stays allowed
- The nautical licence is mandatory for motor-driven small boats and for towing water skiers; under Reg. 1 this applies from 30 hp since 2011, and under 30 hp only from a date set by the Minister. The ban under Reg. 47 covers any licence or permit from the authority.
- Foreign skippers
- The rules apply in Maltese inland and territorial waters. The text does not say how foreign licences are treated.
- Who decides
- Authority for Transport in Malta (Transport Malta); court in case of conviction.
- Legal basis
- S.L. 499.52 Small Ships Regulations Reg. 1 para. 2 b, Reg. 29 (nautical licence), Reg. 34 and 35 (suspension, revocation, handing in), Reg. 45 and 47 (procedure, 12-month ban), Third Schedule (operating under the influence of alcohol 1,000 €).[50]

- How long
- Suspension for no more than 1 year, or withdrawal.
- What stays allowed
- The ordinance applies to boats with at least 5 CV engine power; weaker ones are not covered. The person concerned is heard before the decision.

Netherlands
Suspension in law
- When
- Triggers are boating under alcohol or drugs (Art. 27) and dangerous speeding in a fast motorboat (Art. 4). Repeated alcohol offences on vessels that require a vaarbewijs also count. The criminal court can then withdraw the right to operate (Art. 35b). If there is serious suspicion, the police can impose a boating ban of up to 24 hours at once (Art. 29).
- Alcohol limit
- No more than 0.5 ‰ in the blood or 220 µg/l in the breath (Art. 27 para. 2). Applies to recreational and commercial shipping. Also banned: operating under any substance that can reduce fitness to operate (Art. 27 para. 1). For 'small vessels' (rowing boats under 20 m, sailing boats or boats with an engine up to 6 km/h under 5 m), para. 4 has its own rule: banned if traffic is obstructed.
- How long
- Court withdrawal for no more than 5 years. For a new offence within 5 years after the end of an earlier withdrawal, no more than 10 years (Art. 35b). Time during which the licence was already held is counted. Anyone who hands in the licence late has the withdrawal extended by those days. The public prosecutor can keep the licence until the judgment, among other cases from 785 µg/l breath or 1.8 ‰ blood, at very high speed with serious danger, or if there is a risk of reoffending (Art. 35a). It is returned, among other cases, if there is no hearing within 26 weeks.
- What stays allowed
- The withdrawal applies only to vessels that require a vaarbewijs (Art. 35b: 'voor zover daartoe een vaarbewijs is vereist'). A vaarbewijs is needed for fast motorboats (under 20 m, faster than 20 km/h) and for recreational boats over 15 m. A written complaint (klaagschrift) can be filed against keeping the licence (Art. 35a).
- Foreign skippers
- The 24-hour ban (Art. 29) can be imposed on any person on a waterway.
- Who decides
- Police/investigating officers (24-hour ban, taking the licence), public prosecutor (keeping it until the judgment), criminal court (withdrawal).
- Legal basis

The chief of police can also withdraw the entitlement for a time if someone is not sober or their behaviour shows they are unfit (§ 28 b).
- Alcohol limit
- Recreational boats under 15 m: more than 0.8 ‰ blood or 0.4 mg/l breath always counts as under the influence (§ 33). Applies to motorboats, sailing boats from 4.5 m and commercial passenger transport. Vessels from 15 m: more than 0.2 ‰ or 0.1 mg/l (Sjøloven § 143).
- How long
- Loss by court for at least 1 year, shorter in exceptional cases. After that, the boat operator exam must be passed again (§ 28 a). Chief of police: 'for a certain time' (§ 28 b). Anyone without an entitlement gets a waiting period of at least 1 year (§ 28 c).
- What stays allowed
- The loss covers the right to operate recreational boats that require a båtførerbevis (§ 28 a). Without a licence, people aged 16 and over may operate boats up to 8 m and up to 25 hp (Sjøfartsdirektoratet). For a provisional withdrawal by the police, the district court must decide within 3 weeks unless the person concerned agrees. Penalty for breaches: a fine or up to 1 year in prison (§ 37).
- Foreign skippers
- Licences from EEA states are valid in Norway according to their content; others if they essentially meet Norwegian requirements (Sjøfartsdirektoratet).

Suspension in law
- When
- Anyone who operates a motorised vehicle in land, water or air traffic while drunk or under drugs commits a criminal offence (Art. 178a KK). If the offender was drunk during a traffic offence, the court must impose a driving ban (Art. 42 § 2 KK). At a lower alcohol level ('state after alcohol consumption') it is a petty offence; a driving ban is imposed in that case too (Art. 87 §§ 1, 3 KW).
- Alcohol limit
- Criminal offence: above 0.5 ‰ blood or above 0.25 mg/dm³ breath (Art. 115 § 16 KK). Below that: petty offence in the 'state after alcohol consumption' (Art. 87 § 1 KW).
- How long
- Criminal offence: at least 3 years (Art. 42 § 2 KK); general range 1 to 15 years (Art. 43 § 1 KK). For life, among other cases, for drink-driving again despite a ban or after serious accidents under alcohol (Art. 42 §§ 3, 4 KK). Petty offence: 6 months to 3 years; time during which the licence was taken is counted (Art. 29 KW).
- What stays allowed
- Art. 178a KK and Art. 87 § 1 KW apply only to motor-driven vehicles ('pojazd mechaniczny'). The court sets which type of vehicle the ban covers (Art. 29 § 2 KW; Art. 42 § 2 KK: all vehicles or certain types). Penalty: up to 3 years in prison (Art. 178a § 1 KK); petty offence: detention or a fine from 2,500 zł.

Portugal
Partly regulated
- When
- Boating law (DL 93/2018) does not provide for withdrawal of the carta de navegador de recreio; offences only cost fines. It is a criminal offence to operate a watercraft when you are not able to do so safely, or to grossly break navigation rules and so endanger others (Art. 289 Criminal Code). Anyone convicted of this gets a ban under Art. 69 on driving motor vehicles (veículos com motor).
- How long
- Court ban under Art. 69 Código Penal: 3 months to 3 years, effective from when the judgment becomes final.
- What stays allowed
- The wording does not say whether the ban under Art. 69 also covers boats. Boating without the right carta costs 300 to 3,000 euros (Art. 54 para. 2 m DL 93/2018).
- Driving licence
- Art. 69 para. 1 a Código Penal links a conviction under Art. 289 with a ban on driving motor vehicles for 3 months to 3 years.
- Foreign skippers
- Licences from EU states are automatically valid in Portugal (Art. 39 DL 93/2018). Art. 289 Código Penal applies to anyone who operates a watercraft in Portugal.

Anyone who is not competent or directly endangers people through offences may not continue.
- Alcohol limit
- Up to 0.50 g/kg blood or 0.24 mg/l breath, you count as not under the influence if no signs of impairment appear. Fine levels: up to 0.50 with signs of impairment 300 €, above 0.50 to 0.80 600 €, above 0.80 to 1.10 900 €, above 1.10 at least 1,200 €. - The examining body must suspend or withdraw the certificate of competence (skipper licence) if the holder has been convicted of an offence under the Merchant Shipping Act, has acted negligently or incompetently, or obtained the licence by deception. Operating a boat under alcohol or drugs is banned under the rules for small vessels.
- Alcohol limit
- 0.05 g of alcohol per 100 ml of blood or 0.24 mg per 1,000 ml of breath. It is also banned to operate under the influence of alcohol or drugs if this impairs your ability.
- What stays allowed
- An appeal against suspension or withdrawal can be lodged in writing with the Minister of Transport within three months. Alternatively, a claim can be brought in the High Court. A suspended or withdrawn licence must be handed in on request.
- Foreign skippers
- Foreign skippers with no permanent residence in South Africa count as competent for three months after arrival if they carry their foreign licence. No rule was found on whether it is held for offences.

Spain
Partly regulated
- When
- Anyone who operates a boat as skipper (patrón) under alcohol or drugs commits an administrative offence. For a captain or skipper, this counts as very serious if the ability to operate may be impaired. Withdrawal of the recreational boat licence as a penalty is not in the law; suspension under Art. 312 para. 10 TRLPEMM applies only to professional licences. The recreational licence does expire, however, if a medical examination finds unfitness, for example due to alcohol abuse or dependence; the authority can require a new examination.
- How long
- No fixed period for recreational licences. If someone is medically unfit, the licence expires (caducidad). Under Annex VIII no. 11 RD 875/2014, after past abuse or dependence a positive medical report is only possible again with proven rehabilitation, possibly with a shorter validity.
- What stays allowed
- Allowed without a licence (private use): motorboats up to 5 m long and no more than 15 hp without a power restrictor, sailing boats up to 6 m, beach and floating devices; only in daylight, no more than 2 nautical miles from the starting point, from age 18; not for jet skis. Since 1 October 2026, the exemption applies only to private and sporting use; renters need a licence.
- Foreign skippers
- Anyone who operates a foreign-flagged boat in Spanish waters needs a licence under the law of their home country or country of residence. The offences of the TRLPEMM apply in waters under Spanish jurisdiction; for serious or very serious offences the boat can be detained, with release against security.
- Who decides
- Minor offences: Capitán Marítimo (harbour master). Serious offences against maritime safety: Director General of the Merchant Navy. Very serious: Secretary of State or Minister of Transport. Expiry of the licence: the issuing administration.

Sweden
Partly regulated
- When
- Withdrawal is regulated only for the personal watercraft licence (förarbevis för vattenskoter). It is withdrawn definitively for offences under Sjölag 20 kap. 2 to 5 and 7 to 9 §§, including sjöfylleri and grovt sjöfylleri (drink-boating and aggravated drink-boating), and for certain breaches of navigation rules (Lag 2021:626, 7 §). The basis is a final judgment, an accepted summary penalty order or an accepted fixed penalty (7 a §).
- Alcohol limit
- Sjöfylleri: from 0.2 ‰ blood or 0.10 mg/l breath, for boats that can reach at least 15 knots under engine or are at least 10 m long (20 kap. 4 §). For all boats, it is an offence if you are so affected that you cannot operate the boat safely. Grovt sjöfylleri among others from 1.0 ‰ or 0.50 mg/l (20 kap. 5 §).
- How long
- Waiting period at least 1 month, no more than 3 years (9 §). Provisional withdrawal and taking the licence are possible even before the judgment (7 b, 9 d §§). A new licence is only considered after the waiting period ends (11 §).
- What stays allowed
- The withdrawal covers only personal watercraft (hull under 4 m, jet drive). For other boats, the law sets no withdrawal. There, sjöfylleri is punished with a fine or up to 6 months in prison, grovt sjöfylleri with up to 2 years in prison.
- Foreign skippers
- EEA citizens aged 15 and over may ride with their own country's personal watercraft licence (12 §).

Switzerland
Suspension in law
- When
- After any breach of the traffic rules that carries a penalty, the boat operator's licence (Schiffsführerausweis) is withdrawn or a warning is issued. Being under the influence (from 0.5 per mille) with no other offence is a minor offence; with an additional minor breach it is a moderately serious one. From 0.8 per mille or 0.40 mg/l, under drugs, when boating despite a withdrawal or when refusing a blood test, it is a serious offence. If fitness to operate is lacking, for example due to addiction, the licence is withdrawn for an indefinite period; from 1.6 per mille, fitness to operate is examined.
- Alcohol limit
- From 0.5 per mille or 0.25 mg/l, unfitness to operate counts as proven; penalty: fine (Busse). From 0.8 per mille or 0.40 mg/l (qualified): prison up to three years or a monetary penalty; the police take the licence at once. Commercially used vessels: 0.1 per mille or 0.05 mg/l. Exempt from the alcohol ban are paddle boats, racing rowing boats, sailboards, beach boats, boats under 2.50 m and small non-motorised boats up to 4 m. Lake Constance: 0.8 per mille or 0.40 mg/l.
- How long
- Minor: warning; with a prior record in the last two years, at least one month. Moderately serious: at least one month, with a prior record at least four, nine or 15 months. Serious: at least three months, with a prior record at least six or twelve months. After several withdrawals, an indefinite period of at least two years; for incorrigible offenders, forever. The authority can place the withdrawal in April to September. Reissue follows Art. 17 Strassenverkehrsgesetz (road traffic act) by analogy.
- What stays allowed
- A licence is only needed above 6 kW of propulsion power or more than 15 m² of sail area. The law does not expressly say whether licence-free boats are allowed during a withdrawal; however, the police prevent further travel if someone on a licence-free boat is unfit to operate. Anyone who operates a vessel despite a withdrawal commits a serious offence.
- Driving licence
- Withdrawals under the Strassenverkehrsgesetz (road traffic act) count as a prior record for the boat licence, and the record as a motor vehicle driver is taken into account for the length of the withdrawal. If a road traffic or shipping authority has doubts about fitness to operate, it reports this to the other authority (Art. 17b para. 6 BSG).
- Foreign skippers
- Anyone staying in Switzerland for a limited time may boat with their national licence or the ICC. If someone is unfit to operate, the police prevent further travel and take the licence; the text does not expressly say whether foreign licences can be withdrawn.
- Who decides
- The canton of residence (administrative authority) issues and withdraws the licence. The police prevent further travel and take the licence; until the decision, taking it has the same effect as a withdrawal. Fines and penalties are imposed by the criminal authorities.
- Legal basis
- BSG Art. 17a, 17b, 18a, 19, 20, 20a, 20b, 20c, 21, 21a, 24a, 24b, 41, 58 para. 3, 59; BSV Art. 16 para. 2, 40a, 40abis, 40l, 40m, 40n, 40obis, 40p, 78, 91; Bodensee-Schifffahrts-Ordnung (SR 747.223.1) Art. 6.01, 12.01, 12.08.[31][32][33]

- Since 17 July 2026: anyone who operates a private boat above the breath alcohol limit loses the amateur licence (ADB) for 6 months. The same applies for excessive speed, coming too close to swimming zones, dangerous operation and operating someone else's boat without written authorisation. If someone is medically unfit, the licence is suspended; if requirements are no longer met or by court order, it is revoked.
- Alcohol limit
- Above 0.05 per cent blood alcohol, measured in the breath (Art. 18 para. 6 of the regulation).
- How long
- 6 months; after that, the suspension is lifted on application. After revocation, a new licence only with new training and a new exam (Art. 18 para. 9).

No suspension
- When
- A boating ban is not provided for. Recreational skippers need no boat licence. Alcohol or drugs at the helm are a criminal offence (s. 80 for non-professional mariners). The result is a fine or prison (s. 82). Ss. 78 to 82 contain no withdrawal or ban.
- Alcohol limit
- Limits (s. 81): 25 µg of alcohol per 100 ml of breath, 50 mg per 100 ml of blood (0.5 ‰), 67 mg per 100 ml of urine. For non-professional mariners, the minister can set exemptions from the limit by regulations, for example by engine power, size or location (s. 80 para. 4, 5). It is also an offence if your ability is impaired by alcohol or drugs (s. 80 para. 2).
- What stays allowed
- There is no mandatory licence, so there is nothing to withdraw. Operating under alcohol or drugs remains an offence: up to 2 years in prison and/or a fine (s. 82).

United States
Partly regulated
- When
- Under federal law, operating a boat under alcohol or drugs is only punished with a fine or penalty. Federal law does not regulate withdrawal of a boating licence. Each state decides for itself whether you lose the right to boat. Examples: New York withdraws the right to boat for alcohol and drug offences on the water and for refusing a test. In Michigan, courts can ban the right to operate a motorboat after drink-boating. Florida bans boating after certain offences until a boating course is proven.
- Alcohol limit
- Federal (33 CFR 95.020): recreational boats from 0.08 % BAC, other boats from 0.04 %. Visible intoxication counts regardless of the level. Florida: 0.08 g/100 ml blood or 0.08 g/210 l breath, higher penalties from 0.15 or with children under 18 on board. New York: 0.08 % on non-commercial boats, 0.04 % on commercial boats, plus a separate offence of 'impaired'. Michigan: 0.08 g/100 ml blood or 210 l breath, under 21 any alcohol level.
- How long
- New York: 6 to under 12 months for a first 'impaired' offence, 12 months for 0.08 %, intoxication or drugs, 24 months for a repeat within ten years. Test refusal: at least 6 months and a civil penalty of 200 or 500 US dollars. Michigan: for a first offence 1 to 2 years possible, with a prior offence within seven years at least 2 years, for death or serious injury or two prior offences within ten years with no end date. Florida: boating ban until the course is proven (deadline 90 days); for drink-boating the boat is immobilised for 10 days.
- What stays allowed
- Florida: the ban ends as soon as the boating course is proven. Statute 327.35 itself does not withdraw the right to boat. New York: there is a hearing against the suspension for test refusal, limited to four questions.
- Driving licence
- Florida and New York boating law provide no effect on the car driving licence.
- Foreign skippers
- New York: the law applies to anyone who operates a boat on the state's waters. Residence plays no role there.
- Who decides
- Federal: US Coast Guard (civil penalty) and federal courts. States: courts and state authorities, e.g. in Florida the Fish and Wildlife Conservation Commission (course proof), in Michigan the court.
- Legal basis
- Federal: 46 U.S.C. § 2302(c), (d); 33 CFR §§ 95.020, 95.040. Florida: Fla. Stat. §§ 327.35, 327.35215, 327.731. New York: Navigation Law § 49-a para. 2, 3, 7, 10. Michigan: MCL 324.80176, 324.80186.[77][78][79][80][81][82][83][84]

Frequently asked questions
What is the alcohol limit for skippers in Germany?
0.5 per mille on federal waterways and at sea, 0.8 per mille on Lake Constance. Fines range from 350 to 2,500 euros inland and 750 to 2,500 euros at sea. From 1.1 per mille it is a criminal offence.
Can I drive a licence-free boat while my licence is suspended?
Not in Germany. While a suspension runs, any recreational motorboat is off limits, including those up to 15 hp. Rowing boats, paddle boats and small sailing boats with up to 6 m² of sail remain allowed.
Does a German ban also apply to foreign licences?
Yes. If the German authority withdraws a foreign licence, it may no longer be used in Germany, and the water police can hold it. The alcohol limits apply to everyone in charge of a boat.
How long does a boating ban last?
Germany sets no fixed period. Austria suspends the licence for six months from 0.8 per mille, Switzerland withdraws it for at least three months from 0.8 per mille. Other countries are on the map.
