Where the two differ, the German text decides:
A-2.2.1 Conditions for the benefit. The insured person dies as a result of the accident within one year of the accident. Death caused by the accident also counts as proven where the insured person has been declared dead with legal effect under section 5 (shipwreck), section 6 (aircraft accident) or section 7 (other danger to life) of the German Missing Persons Act (VerschG). If the insured person survived the disappearance, benefits already paid must be repaid.
