Does accident insurance pay for a herniated disc in Germany?
In short
Usually not. Under the German model terms, private accident insurance excludes damage to spinal discs. It only pays for a herniated disc if an accident such as a fall or a rear end collision was the main cause, meaning more than 50 percent. A disc that slips while lifting without an external event is not covered, not even under the increased exertion rule.
Worked examples under the model terms AUB 2020; actual percentages come from the medical report.
Premiums from publicly quoted tariff examples, as of July 2026.
Worked example
Fall from a ladder while cleaning windows
A 50 year old falls two metres onto her back. A lumbar vertebra breaks and a disc is injured. Basic sum EUR 100,000.
Disc exclusion
does not apply, the fall is the main cause
Disability degree
10 percent based on overall capacity
Contribution from wear
20 percent, below 25 percent, no cut
Disability benefit
EUR 10,000
She receives EUR 10,000. Had the disc slipped while lifting the laundry basket, she would have got nothing.
Why a herniated disc is excluded
Spinal discs wear with age, and a herniated disc (Bandscheibenvorfall) usually develops on that basis. An accident is then often just the final trigger, not the cause. That is why the German model terms exclude damage to discs in principle.
The increased exertion rule does not help either. It covers muscles, tendons, ligaments and capsules, and the terms say expressly that discs are not included. If you herniate a disc carrying a washing machine, you have no accident under the model terms.
The exception: an accident as the main cause
The exclusion does not apply if a covered accident caused the disc damage by more than 50 percent. This happens with serious falls, road accidents or jumps from a height, often together with fractured vertebrae.
You need clear medical evidence: imaging soon after the accident showing fresh injury, and ideally little wear on the other discs.

What is paid if the insurer pays
The spine is not in the limb schedule. The disability degree depends on how much your overall physical capacity is permanently impaired, compared with a healthy person of the same age.
If wear contributed at least 25 percent to the consequences, the degree is cut by that share. With disc damage this almost always happens.
Discs and your job: statutory accident insurance
The Berufsgenossenschaft also requires an event acting on the body from outside for a workplace accident (section 8 (1) SGB VII). A herniated disc from lifting at work often fails on that point. But if you have lifted heavy loads or worked bent forward for many years, it may be an occupational disease.
The German Occupational Diseases Ordinance lists under no. 2108 disc related diseases of the lumbar spine caused by years of lifting or carrying heavy loads. You or your doctor can report a suspected case to the Berufsgenossenschaft.
When to protect your back differently
If you want to protect yourself financially against a herniated disc, disability insurance (Berufsunfähigkeitsversicherung) is the better choice. It pays regardless of whether an accident or wear was the cause.
Taking out accident insurance for your back is not worth it. It is meant for accident consequences, mainly for arms, legs, eyes and serious head injuries.
Step by step
After a fall or accident, see a doctor straight away.
Have imaging done soon that documents fresh injuries.
Report the accident to the insurer, even if only your back hurts at first.
Before 15 months, have the disability confirmed and claim it.
After years of heavy lifting at work, report a suspected occupational disease.
Checklist
Accident described with the external event
MRI or CT soon after the accident
Earlier back findings to hand
15 month deadline noted
Disability insurance checked
Common mistakes
Reporting a disc slipped while lifting as an accident and hoping for money
Not getting imaging soon after a real fall
Treating accident insurance as back insurance
Not checking for an occupational disease after years of heavy work
Questions and answers
Frequently asked
Is a herniated disc an accident?
Usually not, because there is no external event and wear is the main cause.
Only an accident as the main cause changes that.
Are there tariffs that include discs?
Whether a tariff words the exclusion more narrowly than the model terms is shown in its disc
clause.
Read it carefully before you sign.
Does the Berufsgenossenschaft pay for a herniated disc?
As a workplace accident only if an outside event caused it.
After years of heavy lifting it may be occupational disease no.

What about lumbago?
Sudden back pain without an external event is not an accident.
Accident insurance does not pay for it.
Which insurance helps with back problems?
Disability insurance, if you can no longer work in your job.
