Is accident insurance tax deductible?

In short

Yes, but often with little effect. As a special expense, the premium falls under the cap of 1,900 euros for employees and 2,800 euros for the self-employed in § 10 EStG, which health and care insurance usually fill. The work share helps more: a flat 50 percent counts as work expenses once yours exceed 1,230 euros. This is not tax advice.

Electrician, employed, commutes 20 kilometres

He pays 180 euros a year for accident insurance, has statutory health insurance and an assumed marginal tax rate of 30 percent.

In total he saves 27 euros a year, about 15 percent of his premium. Working from home and staying under 1,230 euros of work expenses, he would save nothing. A certificate of higher occupational risk can raise the amount.

Two pots: special expenses and work expenses

Private accident insurance in Germany covers you at work and in your free time. Tax law therefore splits the premium. The private part is a special expense (Sonderausgabe): § 10 Absatz 1 Nummer 3a of the Income Tax Act names accident insurance among other pension and insurance expenses. The work part is a work expense (Werbungskosten). Different rules apply to the self-employed.

Under a Federal Finance Ministry letter of 28.10.2009, employees may claim half each without proof. You do not need a certificate from the insurer, the premium invoice is enough.

Why the special expenses pot is almost always full

The cap under § 10 Absatz 4 of the Income Tax Act is 2,800 euros a year, or 1,900 euros for employees, civil servants with state health support and others who receive a health insurance subsidy. Married couples filing jointly add both caps together.

Health and care insurance contributions go into the same pot first. Even on an average salary, they alone exceed the cap. The tax office then deducts the basic health contributions in full, and nothing is left for accident, liability or term life cover. Enter the premium anyway: it costs nothing, and with low income, part time work or as a student it can still help.

The work share: where the real benefit lies

Work expenses have no cap, but a threshold. Every employee gets an allowance of 1,230 euros under § 9a of the Income Tax Act without proof. Only the amount above that lowers your tax. Commuters often get there: since 2026 the rate is 38 cents per kilometre from the first kilometre, so 20 kilometres on 220 working days already come to 1,672 euros.

If your job carries a higher accident risk, for example in construction, trades or the police, the work share may be more than half. Ask the insurer to certify which part of the premium covers the occupational risk and attach it to your return.

Self-employed, civil servants and policies through your employer

The self-employed usually claim private accident insurance as a special expense, with the higher cap of 2,800 euros. It rarely counts as a business expense, because it protects the person, not the business. Clarify any exception with your tax adviser.

If your employer pays group accident insurance for several staff, it can take over the wage tax on the premiums at a flat 20 percent under § 40b Absatz 3 of the Income Tax Act. For you that is a benefit at no cost. Payouts from such a policy may, however, count fully or partly as wages. Ask HR how the policy is set up.

And the payout after an accident?

The one-off disability payment from a policy you paid for yourself is tax free, even if it runs to six figures. It compensates for physical harm and is not income. The same applies to accident hospital allowance and rescue costs from your own policy.

A lifelong accident pension is different. It counts as a life annuity, and under § 22 of the Income Tax Act only the income portion is taxable. That depends on your age when the pension starts and then stays fixed. If your total taxable income is below the basic allowance of 12,348 euros in 2026, no tax is due at all.

When it is not worth the effort

If you stay below 1,230 euros of work expenses and your health insurance fills the cap, accident insurance saves you nothing in tax. Entering it does no harm. So never choose a policy for tax reasons, but for what it pays: base sum, progression and the limb schedule decide what you receive.

Accident insurance with a premium refund is often sold with tax benefits. But the savings part is not a deductible insurance expense, and the gains are taxable on payout, under certain conditions at half. You are usually better off with pure risk cover and investing separately.

Step by step

  1. Find the premium invoice for the year and note the annual premium without any savings part.
  2. Check whether commuting, work equipment and training take your work expenses above 1,230 euros.
  3. Enter half the premium as work expenses in Anlage N, more with a certificate if your job is high risk.
  4. Enter the other half in Anlage Vorsorgeaufwand under other insurance expenses.
  5. If you receive an accident pension, enter it in Anlage R; the tax office calculates the income portion.

Do I need to prove the 50 percent?

No. The half and half split applies without proof. You only need a certificate from the insurer if you want to claim more than half as work related.

Can I deduct my children's accident insurance?

Only as a special expense if you are the policyholder, and that usually has no effect because the cap is full. There is no work share for children.

Is the payout after an accident taxable?

The one-off disability payment from your own policy is not. A lifelong accident pension is taxed on its income portion, 34 percent if it starts at 45.

Is accident insurance a business expense for the self-employed?
