What professional liability insurance do IT freelancers in Germany need?
In short
What IT freelancers in Germany need above all is professional liability insurance for financial loss (Vermögensschadenhaftpflicht) from coding or advice errors, plus general liability for injury and property damage. Data protection, copyright and delay damages should be included. Developers usually pay EUR 120 to 300 a year, with a EUR 1 million limit and cyber cover around EUR 600 to 700.
Consulting, EUR 60,000 turnover, EUR 1 million limit
from about EUR 518 a year
IT freelancer, EUR 75,000 to 100,000 turnover, EUR 1 million financial loss, EUR 2 million general liability, data protection and cyber EUR 150,000, EUR 500 deductible, three year term
EUR 588 net, EUR 699 gross a year

Worked example
Backend developer, wrong price calculation in an online shop
A freelancer deploys new discount logic for a retailer. A rounding error sells every item 20 percent too cheap for two weeks. The retailer claims lost profit and the cost of finding the bug.
Retailer's lost profit
about EUR 45,000 (guide value from our quoting practice)
External developers to analyse the error
about EUR 6,000 (guide value from our quoting practice)
Fixing your own code
not insured, that is your contractual duty
IT liability cover, EUR 500,000 limit
about EUR 200 to 300 a year
The insurer checks the claim, defends excessive parts and pays the justified loss up to the limit. Fixing the code remains your job.
Why general liability is not enough for IT freelancers
Typical losses in IT projects are pure financial losses: a faulty interface miscalculates invoices for weeks, an update takes an online shop down over a weekend, a script deletes customer data. No one is injured and nothing is physically broken, so general liability insurance does not pay.
Even the data protection add-on of a standard German business liability policy helps little. The insurers' model conditions expressly exclude IT consulting, software development, implementation and maintenance there. IT freelancers therefore need dedicated IT liability cover that combines financial loss, bodily injury and property damage.
What good IT liability cover should include
Look for open cover: every IT activity is insured unless expressly excluded, instead of a narrow list. That keeps you protected when a development project turns into consulting or operations.
Also important are data protection breaches, infringement of copyright and trademarks, damage caused by missed deadlines and liability you accept by contract, for example in service level agreements. A cyber add-on for your own costs after an attack is a useful extra, but it is a different type of insurance.

What limits German clients ask for
Medium sized companies and agencies placing freelancers often require EUR 1 million for financial loss in framework contracts, large corporations EUR 3 million or more. With small clients EUR 300,000 to 500,000 is often enough. Choose the limit by the largest loss one error could cause at your largest client.
Limiting liability in your own terms only helps so far. Under section 309 no. 7 of the German Civil Code (BGB), standard terms cannot exclude liability for gross negligence or for injury to life, body or health. A cap for simple negligence is possible but large clients rarely accept it.
When you do not need your own IT liability cover
If you are employed by a staffing company and placed with clients, you are not a freelancer in insurance terms. The milder rules of employee liability apply and your own policy is usually unnecessary. Pure training work without access to client systems carries little risk, so a lean policy may do.
Also check whether your client or agency includes you in a project policy. Some agencies do, but that cover only applies to that project and ends with it.
Step by step
Describe your activities precisely: development, consulting, operations, support, training.
Check which limit your main clients require in their contracts.
Choose a policy with open cover for IT work plus general liability.
Make data protection, copyright and delay damages must haves.
Decide whether you need cyber cover for your own losses after an attack.
