What your employer and the statutory system already cover for nurses

As an employed nurse or care worker you are covered by statutory accident insurance (gesetzliche Unfallversicherung), paid entirely by the employer. It covers accidents at work, on the direct commute and recognised occupational diseases. For nurses this matters: infectious diseases count as an occupational disease when you work in healthcare or welfare. A pension is only paid from a 20 percent reduction in earning capacity.

If you injure a patient on duty, the hospital or care home normally answers to the patient through its business liability policy. Towards your own employer, German labour courts apply a sliding scale: no liability for slight negligence, a shared amount for medium negligence, and usually full liability for gross negligence or intent.

Priorities: what nurses should insure first

Sort by what could ruin you financially. For nurses and care workers that is losing the ability to work, then liability in private life and on duty. Everything else comes later.

Why disability cover is expensive for nurses and still comes first

Insurers put nurses into a high risk group, so premiums are above those for office jobs. A documented share of organisation or admin work can improve the rating. The state pays little: the statutory reduced earning capacity pension (Erwerbsminderungsrente) only applies if you can work less than six hours a day in any job. Anyone born from 1961 onwards has no protection for their trained profession.

Look for an infection clause (Infektionsklausel). It secures the pension if the health authority bans you from patient work under the Infection Protection Act (Infektionsschutzgesetz), even though you feel well.

Liability on the ward: when nurses pay themselves

Gross negligence is quickly alleged in nursing, for example after a medication mix-up despite clear instructions. Your employer may then claim money back, and a criminal investigation for negligent bodily injury may follow. You need work liability and criminal legal cover for that.

One nursing association, for example, covers its employed members with EUR 5 million for personal injury and property damage, EUR 100,000 for lost keys and EUR 150,000 for financial loss, plus employment, social and criminal legal cover with a EUR 250 excess after six months of membership. Its liability cover only applies if the employer's policy does not pay.

Shifts, commuting and your own car

The direct way to work is covered by statutory accident insurance even at night after a shift, private detours are not. If you drive your own car on home care rounds, get written confirmation whether your employer pays for damage to it. That is set by your employment or collective agreement, not by law.

What nurses usually do not need

A separate employment legal policy is not worth it if your association or union already provides legal cover for work. Accident insurance does not replace disability cover, because most nurses stop working due to illness, not accidents. Self-employed carers need different contracts; there are separate pages for business types.

Step by step

  1. Ask your employer how high the business liability cover is and whether you are named as insured.
  2. Check whether an association or union already includes work liability and legal cover.
  3. Apply for disability cover as early as possible and answer health questions carefully.
  4. Describe your duties precisely, including any share of management or organisation.
  5. Take out or check personal liability with at least EUR 10 million cover.

Checklist

  • Disability cover with infection clause and no abstract referral (abstrakte Verweisung)
  • Work liability via association, union or own policy
  • Criminal legal cover for negligent bodily injury allegations
  • Lost work keys covered
  • Clarity on who pays for damage to your own car on work trips

Common mistakes

  • Delaying disability cover until back or mental health issues are on file
  • Assuming the employer pays every claim, even for gross negligence
  • Buying accident insurance instead of disability cover
  • Paying twice for legal cover the association already includes

Questions and answers

Frequently asked

Do employed nurses in Germany need their own professional liability policy?

It is not compulsory.

Cover for gross negligence and criminal proceedings makes sense,

and many associations and unions include it in the fee, so you may not need a separate policy.

How much is disability insurance for nurses?

Published examples start at EUR 59 a month for trainees and EUR 72 to 88 for young qualified

nurses.

At 30 with cover to 67, EUR 80 to 140 is common.

Is an infection caught at work covered?

Infectious diseases in healthcare are a recognised occupational disease,

so statutory accident insurance pays.

Whether a pension follows depends on the reduction in earning capacity.

Does statutory accident insurance pay for back damage from lifting?

Only for a work accident or recognised occupational disease.

Wear and tear over years is usually not an accident, which is why disability cover matters more.

Is joining a nursing association worth it for the insurance alone?

At EUR 7 to 37 a month it often pays off compared with buying legal and work liability cover

separately.

Read the terms, such as waiting periods and excess.

Which insurance do nursing trainees need?

Mainly disability cover, because premiums are lowest when young and healthy,

from EUR 59 a month in examples.

Also check whether you are still covered by your parents' personal liability policy.
