Which professions need professional liability insurance in Germany depends on professional law. It is mandatory for lawyers, notaries, tax advisers, doctors, many architects and insurance intermediaries; without proof there is often no licence. For freelancers who advise, plan or write code it is optional but sensible. Low risk freelance work starts at about EUR 80 a year.

Without a policy you pay over EUR 25,000 yourself. With a policy you keep only the deductible, usually a few hundred euros.

Professions where it is mandatory

For chamber professions (Kammerberufe) German professional law requires the insurance, often with a fixed minimum limit. If you cannot show it, you will not be admitted or you lose your admission. For doctors the rule is in the professional codes of the federal states, for architects and engineers in state law, so the limits vary.

Some licensed trades also need the policy for their permit, such as insurance intermediaries and investment intermediaries. Their minimum is above EUR 1.5 million per claim.

Freelancers without an obligation

Many people moving to Germany start as freelancers (Freiberufler) in IT, consulting, translation or design. None of these is required by law to insure, but one missed deadline, wrong advice or bug in your code can cost a client more than your yearly income.

German clients and agencies often ask for a certificate of insurance before signing. Then the policy is not a legal but a business requirement.

What the term covers

Professional liability (Berufshaftpflicht) is not one fixed product. For consultants, lawyers and tax advisers it usually means financial loss liability (Vermögensschadenhaftpflicht), which pays for pure money losses. For doctors, midwives and architects it also covers injuries and property damage.

If you know professional indemnity or errors and omissions cover from home, the idea is similar. Check which types of damage the German offer actually includes, not just the name of the tariff.

When you do not need your own

As an employee, your employer is liable to clients first. Under German case law you are liable to your employer only in part and usually not at all for slight negligence. Your own policy is then only needed in special cases, such as employed doctors with side work.

If you only sell goods or work with your hands without giving advice, business liability insurance (Betriebshaftpflicht) is usually the better fit.

Is professional liability mandatory for freelancers in Germany?

Only for certain chamber professions and some licensed trades. Designers, translators or IT consultants have no legal obligation, but clients often ask for it.

Do foreign doctors working in Germany need it?

Yes, if they treat patients on their own account. Employed hospital doctors are usually covered by the hospital, but not always for side work.

Can I keep my policy from my home country?

For chamber professions the German chamber decides whether a foreign policy is accepted. Often you need a German or EU insurer that meets the German minimum limits.

What happens without mandatory insurance?

In chamber professions you may lose your admission, in licensed trades your permit. You are liable for damage with your own assets.

How high should the limit be?

At least the legal minimum, better as high as your largest possible loss. For consultants EUR 250,000 to 1 million is common.

Can I deduct the premium from my taxes?

Yes, as a self-employed person it is a business expense. Ask a tax adviser for your case.
