Houseboat holding tank leaking: who answers for the pollution?
Short answer
While the contents stay inside the boat, a leaking holding tank is a maintenance job.
Once they reach the water it becomes a pollution incident,
and the person answering for it is the owner of the boat it came from.
A holding tank sits low in the hull where nobody looks, and it rarely fails all at once. It starts at a hose clip, at a discharge hose that has gone hard with age, or at the tank spigot, and the first signs are a smell that will not air out and a damp patch underneath. If the contents reach the bilge and the bilge pump then sends them over the side, what began as a plumbing job has become a pollution incident in the marina or on the navigation.
That step changes the question entirely. Responsibility for what goes into the water attaches to the boat it came from, and the navigation authority or the environmental regulator can require the clean up to be carried out. The marina will pass on its own costs, and both land with the owner. If you want to know how a claim of that kind would be handled, the place to look is the liability section of your own wording, together with the limit that applies to pollution; it is a question worth asking your broker before you need the answer.
Prevention here is cheap. Look over the hoses and clips once a year and replace anything that has gone hard or cracked, because a sanitation hose ages faster than the other lines aboard. Do not run the tank to the brim, and empty it at a pump out station in good time. A tank level gauge and a vent filter are not luxuries, they are your early warning. And if something does escape: stop the bilge pump first so nothing more goes over the side, tell the marina, and call your insurer before you instruct a contractor.

Pollution
follows the boat it came from
As long as nothing goes over the side, it stays a maintenance job.
Questions
What owners ask us about this
Who answers if sewage reaches the marina basin?
The owner of the boat it came from. Responsibility for what enters the water follows the source rather than the question of who made a mistake, so it is worth stopping the discharge before anything else.
Would liability cover deal with the clean up?
That depends on your wording. Read the liability section and the limit that applies to pollution, and ask your broker how a claim of that kind is handled before you need it. Call the insurer before you instruct a contractor.
How do I spot a leaking holding tank early?
By the smell that will not air out, by damp patches under the tank, and by a bilge pump that runs more often than it used to. Once a year with a torch under the sole is usually enough to find it while it is still cheap.
Can I empty the tank on the water?
Generally no. On inland waterways and in harbours the contents belong in a pump out station, and discharging them is not permitted. Your navigation authority sets out what applies where you are, so check before you assume.
