A template for a sale between private individuals. Page 1 takes the parties, the subject of the sale, the price and the passing of risk with the date and the time of day, page 2 the condition with the declaration on previous damage and the inventory list as annex 1, page 3 the papers handed over, the handover record and the signatures. Print all three pages twice, one original for each party.

Ownership passes on payment in full. Benefits, burdens and the risk of accidental loss pass to the buyer with the handover, on the day and at the time of day stated above. Until then the seller carries the risk and keeps his cover in force, after that the buyer. Both confirm that they have informed their insurer.

The seller warrants that he is the sole owner and that the vessel is free of third party rights, liens and security assignments. Name any existing rights here and redeem them before payment:

§ 5Condition, previous damage, exclusion of liability

The vessel is sold used and with liability for defects excluded. The exclusion does not apply to injury to life, limb or health, to intent and gross negligence, nor to defects fraudulently concealed or to warranted qualities.

The seller declares that, beyond those named below, no collision, grounding, fire, sinking or storm damage and no osmosis or laminate damage are known to him:

Why § 4 and § 5 decide about your insurance

“On handover” without a date and a time of day is the most common gap: if the boat is lost on the delivery trip, two insurers argue about whose day it was. And what is not written in § 5 you cannot declare in your proposal, with consequences for the whole policy. Leave neither field empty.

This list is more than a formality: it is the basis of the sum insured. Anyone who leaves out rig, sails and electronics is underinsured, and then even a partial loss is cut back pro rata.

§ 6Handover record

The vessel was handed over and accepted on the day stated above in the condition agreed. The buyer has inspected it and has either carried out a sea trial or expressly waived one. Photographs of the condition at handover were taken by both parties.

§ 7Side agreements and notes on the handover

Everything agreed by word of mouth belongs here, otherwise it does not count (§ 8). For example: parts to follow with a deadline, open repairs, berth and winter storage costs, a sea trial agreed after the sale.

§ 8Final provisions

Beyond those listed in § 7 there are no side agreements. Amendments and additions must be in writing. Should one provision be invalid, the rest of the contract remains in force. German law applies; the place of performance is the place of handover. This contract is signed in two counterparts; each party receives one original including annexes 1 and 2. Every page is to be initialled by both parties.

Before you sign: two calls worth making

Settle the question of insurability while you can still negotiate; type, year of build, value and cruising area are enough for a reliable answer.
