Do I have to pay after an accident in a company car?
In short
After an accident in a company car on a business trip in Germany you pay nothing for slight negligence, part of the damage for medium negligence and usually all of it for gross negligence. Courts often cap liability at about one gross monthly salary for medium and three for gross negligence. On private trips you usually have to pay at least the agreed excess.
What you can realistically expect to pay after an accident in a company car in Germany.
Example
Typical range
Liability cap for medium negligence, common benchmark
about 1 gross monthly salary
Liability cap for gross negligence, common benchmark
about 3 gross monthly salaries
Comprehensive cover excess on company cars
usually EUR 300 to 1,000
Own share on private trips in a sample agreement
about EUR 500 to 1,000

Your case depends on fault, contract and income.
Worked example
Reversing into a bollard
A sales rep earning EUR 3,500 gross misses a bollard when parking. Damage EUR 4,000, comprehensive cover with EUR 1,000 excess.
Rating
medium negligence
Comprehensive cover pays
EUR 3,000
Employer's remaining loss
EUR 1,000 excess
Employee's share, about half
around EUR 500
The employee bears about EUR 500, well below a monthly salary. With slight negligence it would be EUR 0.
Business trips: rules on employee liability
If the accident happens on a business trip, German labour courts apply special rules on employee liability (innerbetrieblicher Schadensausgleich). For slight negligence, such as a brief slip, you are not liable at all. For medium negligence the damage is shared. For gross negligence, ignoring what anyone would have seen as obvious, you are usually fully liable.
For large damage courts often cap liability. Many judgments use about one gross monthly salary for medium and three for gross negligence. The size of the loss, existing insurance and your income also count.
Degree of fault
Example
Your share
slight
brief slip while manoeuvring
nothing
medium
not looking properly when reversing
part of the damage
gross
well over the speed limit, red light, phone at the wheel
usually all, often capped
intent or alcohol
deliberately risky driving
full, cap not guaranteed
Your employer must prove your fault
Under section 619a of the German Civil Code (BGB) your employer must prove that you are responsible and how serious your fault was. Do not sign an admission of fault or a payment agreement right after the accident.
A clause making you liable for every damage to the company car is invalid because it overrides these principles to your disadvantage.
Private trips in the company car
If you use the company car privately, the business trip rules do not apply. Many company car agreements therefore set a fixed amount you bear for self inflicted accidents on private trips, often the comprehensive cover excess. The employer's comprehensive insurance pays the rest.
Read your company car agreement carefully. If it says nothing, the employer can in principle claim the full damage after a private trip, as far as no insurance pays.
What the company car insurance pays
Damage to other cars and people is paid by the company car's motor liability insurance, in which you are covered as driver. Damage to the company car itself is only paid by comprehensive cover (Vollkasko). If someone else caused the accident, their liability insurer pays and you pay nothing.
Step by step
Report the accident to your employer at once, and to the police if anyone is hurt.
Take photos and note witnesses.
Do not sign an admission of fault.
Check your company car agreement for excess and private trip rules.
If you get a claim, ask the works council or an employment lawyer.
