What is an underwriting agency, and who carries the risk?

Short answer

An underwriting agency sits between broker and insurer with delegated authority:

it rates the risk, writes the contract and handles the claim in the insurer's name.

It is not the insurer, and the difference shows in who answers the telephone.

British and Irish owners know the shape of this from Lloyd's: a broker who places the boat, a market that carries the risk, and in between a coverholder or managing agency working under a binding authority. The German term for that middle role is Assekuradeur, and it describes the same arrangement. Such an agency does not simply pass a proposal along. It looks at the risk, decides whether to write it, sets the terms and the rate inside the authority granted to it, and handles the claim when one comes in.

The distinction worth holding on to is the one about authority. A broker acts for the client and shops the market, but the decision belongs to the insurer at the end of it. A tied agent works for one house and forwards the proposal there. An underwriting agency decides itself, within the limits of its binder, which is why an answer arrives in one step rather than three. What such an agency never does is carry the risk. The balance sheet behind the contract belongs to the insurer named in the schedule, and that is where the money for a claim comes from.

NAMMERT works as an Assekuradeur for boats and yachts, and the risk carrier behind the contracts is Württembergische Versicherung AG. NAMMERT designs the cover and the wordings; the insurer decides on claims. Cover is arranged through the broker Norman Nammert. The company designs the cover concepts; the insurer underwrites and settles claims. For an owner it means that the people who wrote the wording also handle the claim file. Insurable with us are also racing boats, jet skis, electric foils, home builds and older yachts. The question to ask any agency, in Germany or in London, is a plain one: what does the binding authority allow, and which company stands behind it?

Two names on the paperwork, one place to ring. Ask what the binder allows before you need to use it.

Questions

What owners ask us about this

What is an underwriting agency?

An intermediary holding delegated authority from an insurer. It rates the risk, writes the contract and settles claims in the insurer's name, inside the limits of a binder.

Is an underwriting agency the same thing as an insurer?

No. The agency writes and administers the business, while the insurer named in the schedule carries the risk and funds the claim. Both names belong on the paperwork.

How is it different from a broker?

A broker acts for the client and places the risk with someone else who decides. An agency with a binder decides itself, which shortens the route but also narrows the market being looked at.

Who should I talk to about a claim?

The agency that wrote the contract, because that is where the authority to decide sits. Ask at the outset in which language claims are handled and who signs off a figure.
