Where the two differ, the German text decides:
1 the person causing the harm had their permanent residence in the Federal Republic of Germany both at the time of the insured event and at the time the attempts at enforcement failed, 2 the insured person proves, irrespective of the enforceable title, that their liability claim is justified in principle and in amount, taking into account the facts actually underlying the insured event and the statutory provisions of a private law nature.
