A-11.2 Excluded are claims for losses, Watercraft Liability Insurance, Premium

1 caused by items manufactured or supplied, work performed or other services rendered by you (or on your behalf or for your account by third parties); 2 arising from planning, advisory, construction or assembly management, inspection or expert activity; 3 arising from advice, recommendations or instructions to economically affiliated companies; 4 arising from brokerage transactions of all kinds; 5 arising from the provision of information, translation and the organisation of travel; 6 arising from investment, credit, insurance, real estate, leasing or similar economic transactions, from payment transactions of all kinds, from cash management, and from breach of trust or embezzlement; 7 arising from rationalisation and automation; data capture, storage, backup and restoration; exchange, transmission and provision of electronic data; l rationalisation and automation; l data capture, storage, backup and restoration; l exchange, transmission and provision of electronic data; 8 arising from the infringement of personality rights and name rights, industrial property rights and copyrights, and of antitrust or competition law; 9 arising from failure to observe deadlines, dates, preliminary estimates and cost estimates; 10 arising from breaches of duty connected with activity as former or current members of a management board, executive management, supervisory board, advisory board or other comparable management or supervisory bodies or organs; 11 arising from knowingly departing from statutory or official regulations, from instructions or conditions of the client, or from any other knowing breach of duty; 12 arising from the loss of items, including for example money, securities and valuables; German law applies to the contract. The German wording of the conditions alone is binding; this translation is provided for understanding only. 13 arising from losses caused by continuous emissions (for example noise, odours, vibrations).

A-12 Default cover A-12.1 The default cover serves to give you, as the keeper of a watercraft, assistance if you are harmed by a third party who has no watercraft liability insurance of their own. That is, the default cover puts you in the position you would be in if the party causing the damage had watercraft liability insurance with Württembergische Versicherung AG on the same terms as your existing one. The cover of the default cover is therefore defined by these conditions for watercraft liability insurance. The exclusions named there also apply to the default cover. In addition, the conditions set out below also apply.

A-12.2 Included, in accordance with the conditions applicable to this watercraft liability insurance and within the sums insured, is the legal liability of another keeper of a watercraft for losses that you yourself suffer as the keeper of a watercraft, if and so far as the justified claim for damages against the party causing the damage cannot be enforced because that party does not have the necessary financial means or has not taken out adequate liability insurance (default cover). The claim for damages must amount to 2,500 euros or more (threshold). The other keeper of a watercraft cannot derive any rights from this contract.

A-12.2.1 Provisional cover for new risks is not part of the default cover.
