Where the two differ, the German text decides:
The obligation to pay arises if, with regard to the claim for damages, 1 a final and enforceable judgment for the liability loss has been obtained against the party causing the damage, or an enforcement order has been issued; 2 a settlement enforceable in court has been concluded with the party causing the damage; 3 a notarial acknowledgment of debt with a submission clause by the party causing the damage exists, showing that the party causing the damage personally submits to immediate enforcement against all of their assets, and every reasonable attempt at enforcement has failed.
