Clause A-12.4, Failed attempt at enforcement, from Watercraft Liability Insurance, Premium, AVB WSH Premium (01-2025nam).
German law applies; only the German wording is binding.
This English text is a courtesy so you can read what you buy, not a contract document.
Where the two differ, the German text decides:
An attempt at enforcement has failed if the insured person proves that 1 enforcement did not lead, or did not lead in full, to satisfaction of the claim for damages, 2 even partial satisfaction appears hopeless because of proven circumstances, for example because the party causing the damage has made a statutory declaration of assets in lieu of an oath or is listed in the register of debtors. To prove the failed enforcement, the insured person must produce the enforcement record of a bailiff showing that the enforcement was unsuccessful (fruitless).
